selling raw cards on ebay question

If someone sells a raw card on ebay, does the seller have to call it a reprint?
I've seen some listings that don't say it's a reprint in the title, but in the item details it will say reprint and the seller will write a comment like, "I believe this card is real but ebay makes me call it a reprint."
What are eBay's rules on this?

Also, even though the seller says "I'm calling this a reprint per ebay rules although I do not know...", 99% of the time it is a reprint. Most sellers are dumb enough to sell a legit card as a reprint..they'll find a way to not call it reprint if they truly believe it's legit.

1986 Mario Lemieux rookie card reproduction
1986 Michael Jordan rookie card reproduction
ETA: I thought the 63 Pete Rose was on the list at one time, but either dreamed it or they've updated the list.
