I've had people pinch my item descriptions and/or photos. It seems the polite thing to do would be to ask, but I try not to sweat the small stuff.
Although, I have been tempted to upload an image saying "I Steal Images From Other eBayers Because I'm A Lazy Bastid!" using the same URL and image name so it shows up in their listing.
I believe eBay nowadays has a "feature" where -- unless you check some box to disallow it -- your item description and pictures become part of their "catalog". This allows other sellers to pull pics and descriptions from the eBay "catalog" for their own listings. That could be the case here.

Years ago, a friend of mine - not me, I swear - had an image from one of his auctions stolen. And the guy actually linked to my friend's URL instead of actually downloading and using a copy of the photo. My friend found some porn, replaced the file and then reported the guy to Ebay. I believe he got booted but I'm not 100% certain of that.
