Filing a USPS insurance claim....whose legwork is this? UPDATE

If the tracking numbers shows as delivered, yet the buyer claims he/she didn't receive the package, what responsibility does the seller have?

The form has a spot to select if the sender or receiver is filing the claim, so obviously it can be done by either. I'm interested to hear opinions or maybe personal experiences.

    I feel that it is the seller's responsibility. If this is an ebay transaction, the only thing the buyer has done was purchase the product. It is the seller's responsibility to get the item to the buyer. Obviously, the buyer needs to fully cooperate with the seller through the claims process.

  • In a situation such as this I think the best approach would be to have the buyer file the claim since they are in the location were the problem occurred and have access to the post office that would have delivered the item to the wrong address. The seller is limited to only stating the buyer says it was not delivered and will most likely be told it WAS delivered and that will be that. The buyer who has not received the package can give details and even go in person to the actual post office were the error occurred and be able to talk to them in person and have a much better chance of convincing them it was not

    The submitter will need the shipping receipt. The submitter will usually be the one out the money, which most of the time will be the seller if the buyer was successful exercising his rights with Ebay/Paypal/Credit Card Co. If you followed Paypal rules to the letter you should be eligible for their seller protection so filing with the PO won't be needed if your buyer was reimbursed for the loss. I don't what level of insurance you purchased, but if tracking shows delivery then it might be hard getting money out of the PO. Buyer and Seller protection through EBay and PayPal should cover both ends if all rules were followed.

    Last time I checked with Paypal, they said it was the sellers responsibility to make the insurance claim.

    A few years back, I purchased a card that was stolen out of package. Fortunately I had to sign for it so the PO person saw the ripped package. I was told the seller had to file the claim as the seller was the one who purchased the insurance. But it took both of us. Seller had to file the claim but needed photo of the ripped package from me. I got back my purchase price and I think seller received insurance money.

    So, I did end up filing the USPS insurance claim last week. I mailed the forms off, which is what the post office guy told me to do. The buyer has messaged me every other day asking if I have heard anything and keeps asking me to refund the payment. I have told him several times that I wasn't comfortable doing that until the insurance claim is paid off. Tonight he told me to either refund the money or he is escalating the Ebay case.

    Considering that the USPS tracking shows as 'delivered', do I have anything to worry about here?
  • If it shows delivered, I don't think you'll have any trouble winning the case unless it was over $250 which requires signature.
    Also if it shows delivered, doubtful that usps will pay the claim

    the address was correct. His local Post Office claims responsibility and encouraged us to file the claim

    I ended up escalating the case with Ebay and within 3 hours, they closed it in my favor.

    hmmm wonder what happen to the package. Any chance the guy received it and claim never got it?
