He then files a cc charge back in november, I supplied the tracking # showing delivered.
Today I get notification thet took $52 from me.. scary to think even with positive feedback and proof of delivery he can steal my card and money

Apparently eBay and PayPal don't think so.
Probable cause: Cardholder reviewed this transaction on their statement and does not recognize the item or does not remember making the purchase. This could be due to an unrecognizable merchant name.
What should you do now?
Provide an invoice showing the transaction detail including a description of the merchandise or services that were provided.
Preventive steps

sided with me, then a week or so later I get an email saying they refunded $52
and I looked into it and saw a counter claim by the credit card company.
I sent the buyer an email asking why he stole $52 from me.

+1 on calling. got a bank chargeback on a $300 ebay sale last month (90 days after shipping the item!), and got nowhere until I called. Although I love to hate on paypal for what is generally terrible customer service, their phone support for merchants has improved dramatically over the last 6 months.

He said they have no way to know what I shipped. I explained it was an ebay transaction with proof of delivery and positive feedback
and it was 90 days ago. He says they have 6 months to make a claim!! I said so they can just make a claim that it wasn't what they ordered,
even though they left positive feedback and 90 days have passed. He says yes, I say so they can just say it wasn't what they wanted, keep it, and get refunded.
He responds they should have returned it. But they didn't, you required me to provide my tracking info, and I do. They don't do anything other then say no thank you to the charge
and keep my stuff and my money? He was like it isn't a paypal issue you have to take it up with the credit card co. Ok, how do I get that, you need to contact the customer.. ohh contact the scammer

it is ebay and I sell some expensive things, so anyone can pull this and rob me blind? How in the world can I keep selling? He says they would have to have proof they returned it......
are you kidding? I just told you he didn't return it!! He says.......... then you have to take him to court! haha so the answer is yes, they can rob you blind by simply disputing and you have 100%
no seller protection.

I had the EXACT same scenario happen recently. Guy won an auction back in July. Paid for his item. I shipped with tracking. Delivery confirmed. He left positive feedback.
I get a chargeback notice from PayPal in October...saying they are removing the money from my account until they can deal with the buyers credit card company directly.
I send them the tracking number showing the item was delivered to the buyer. To his verified PP address. I also show that he left me positive feedback for the transaction.
2 weeks later I get a note saying I was covered, and the money was returned to my account by Paypal.

Same exact thing happened to me two years ago. Money was removed from my account, but after providing
tracking info to paypal, paypal sided with me. My buyer's claim was it was an 'unauthorized charge', that they didn't buy the item.
Maybe a room mate or friend used their CC to make the purchase. In any event, I won my claim by
just providing the proof of delivery.
Sorry to hear you going through this Oakesy25. It just sucks. But keep fighting it, I think
you can win your case.

I don't why it happens, but it happens. I've seen it on ebay/paypal boards multiple times and I'm pretty sure it's happened here before.

That is a very honest buyer right there...when you read threads like these it's usually the opposite, unfortunately.

Don't Ever....2 years ago that's how I saw 1700 listings go Poof and was banned from E-Bay for 60 days. E-Bay doen't do crap to help Sellers except if you do any kind of retaliation, then they drop a Brick on You!!!

Yes they can! But if you don't have a Bank account tied to your Paypal it can make it very difficult to do business in certain transactions. That's why I have a second account at the same bank, and I sweep my account everytime it gets to $200 into the second account. Also don't forget to cancel any Overdraft protection you have on the primary account, because my Bank tells me that Paypal can't grab money that's not in your account....Unless there is overdraft protection of say $1000, they can take it up to that amount. Secondly make sure you delete any secondary accounts you have with Paypal as if your First line account is swept clean and there's no Overdraft they can just switch over to your backup account and take the money from there or its Overdraft protection!!

Yes. In my case, I sweep my paypal account clean daily, so they just automatically charged my credit card on file for the amount of the chargeback without my permission..
This is a mistake by the credit card company. I paid for a bunch of ebay items at once and I am trying to get my money back on a different item that came back from BGS as altered. I'll call my credit card company ASAP and get this chargeback cancelled. sorry for the trouble. It's a mistake by the credit card company. I explained it once to them already but they didn't get it right.

If it comes to doing something like this use a little common sense so it isn't obvious that it is retaliation. You didn't use the same eBay account to do this back to the person did you? Different ebay acct, name/mailing addy and a different IP addy are just a few things I would make sure do not match up before doing this back to a scammer.
