Rather unique ebay situation

I purchased a card last thursday and I was planning on paying tomorrow when I get paid. The seller opened an unpaid item case against me on Monday then relisted the item with a bin. The bin sold yesterday.

What the heck? Now I emailed the seller asking for an explanation or at the very least to cancel the transaction because if I pay and do not get the card anyway thats looks really bad for him

    eBay allow NPB claims after 4 days. You should have told him you were going to take a week to pay.

  • Did you communicate your plan with the seller to pay a week after the auctions close before you bid, or after? I rarely sell on ebay but when I do I will open a case three days after the auction closes if I haven't received payment or communication from the buyer. I also usually add to my auctions description "Please do not bid if you can not make payment in a timely manner (within 3 days)".

    Just my two cents.

    you probably shouldn't have bid if you knew it was going to take you a week to pay unfortunately

  • Its funny buyers expect to have it shipped within 1 day or they give you low DSRs on shipping. I have seen an increase of slow or even non-paying buyers by atleast 50% lately. I am sure you would be more than willing to provide less than 5 stars on the seller if roles were reversed and he took 4 days to mail it out. Just my 2 cents.

    I may whine a lot when I get frustrated with a seller, but I do pay instantly when I hit BIN and also pay within minutes to hours of winning an auction. I think that's a buyer's responsibility to pay in a timely manner.

    So wanting to pay after next payday should be a request made prior to bidding. You said you told him. You didn't say when. If you sent your request after you bid and did not get an ok back from the seller, or a lot worse, you sent it after you won, then that's not being a reasonable buyer expecting to force the seller into that situation. Then in these cases you really sent a command and not a request. In these cases, the seller is justfied.

    Next, it also, depends what type of seller you are dealing with. Even if he did confirm your request. Is it a power seller? Someone with over 5,000 ebay transactions? Then maybe you'd have a beef. Whine like I do to these guys on the boards. get it out of your system and move on like I do. Or perhaps it is a "garage sale" type seller with under 1,000 rating with a few items to sell here or there. Think about it. You need to wait until next paycheck in order to pay. The seller may be in the same boat and may really need the money today for gas, food, kids' braces, whatever and maybe someone gave him a cash today offer. Im sympathetic to that.

  • as mentioned, it sounds like a case of bad communication between both seller and buyer. Hardly a unique situation on eBay.
  • I say pay and force the refund. Was the BIN higher than what you won the card for?

    I really doesn't matter if it takes the buyer a week to pay, he is still within ebay's time frame for payment. A NPB case can only be opened after 4 days....then the buyer has an additional 4 days to answer and pay. The seller took a chance here and relisted before hearing from the buyer and waiting for ebay's clock to count down. Now the seller is on the hook IF the original buyer pays. Hopefully seller learns a patience lesson here.

    The OP could have contacted the seller and let him know his plan, but he was under no obligation to do so, as his total time befrore paying would be 7 days, a full day inside ebay's rules for payment.

    Unfortunately not. How about if you hold off clicking on BIN's until you have the money in your account to pay for the card you're buying. You didn't ask him if you could pay in 7 days prior to buying, and you didn't tell him about your plan to pay in a week until after the NPB case was opened. If you're planning on buying that way you need to communicate with the seller prior to buying. Some people have their account set up to automatically file after 4 days, or will file after 4 days if they hear nothing from the buyer. He probably wasn't aware he made a mistake when he immediately relisted the card for sale when filing the NPB, but that mistake never would have been made if you communicated your intentions anytime prior to filing of the NPB. Don't punish the seller for your poor communication.
