Trial date for thief is October 23, 2012 - UPDATE

Some of you might remember the thread about this.

On Saturday, October 8th, 2011 at the New Market, MD Coin Show we had a theft. The thief sold the coins that day to a dealer in the next town and we recovered most of the coins stolen. He used his driver's license and it was the guy who we suspected.

WELL The thief has been caught and I received a subpoena to appear in court on October 23, 2012 at 08:30 in Frederick, MD as a witness. Hopefully, it will be more than just a slap on the wrist.

    The attorney for the accused told myself and the three people who had coins stolen he was asking for a continuance in order for his client to have enough time to come up with the money to pay Matt (Downtown Coin) for the coins he bought. Matt told the attorney it wasn't about the money, it was about getting this piece of scum off the streets because he was a menace to the coin dealers and the collecting community, as he had stolen from many other venues. The attorney was granted a one time continuance for "having just received the case last night." The trial will be sometime in early January.

    Asking for a continuance is standard operating procedure in these cases.

    Often, the defendant's attorney is hoping that the witnesses get tired of the runaround and don't show up for the next date, or the witnesses are out of town and get tired of making travel arrangements.

    It is important for us to remember to keep the case going, regardless of any delay tactics used by the defendant's attorney.

    If he winds up with any period of probation in addition to other components of sentencing, as a victim, DON'T FORGET to ask the prosecutor to request that he be BANNED from attending any coin show during his period of probation. It is a legal condition of probation to bar him from such venues and if made a condition, he could be arrested for Violation of Probation simply by setting foot in a coin show venue. Obviously the longer the period of probation, the longer he could be banned. Just a tip from former prosecutor.

    What was the value of coins stolen? Most of what he gets will depend on prior stuff he has done. You have to be a pretty dumb thief where i live to get any real time in jail, they are to busy locking up the sex cats, drug and alky's to worry with a thiefimage I had 20k in ATV's stolen and the popo darn near said they would not activly look for them.

    I was lucky as i found them 6 hours later and to this day no one was arrested. I found them 2 miles away under a tarp behind a house fence in a upscale subdivision where the houses start at 400k and go up.
