59 Mantle - Need a Little Help....

Long time reader, seldom poster. After following you guys for years, I have a situation that you might be able to lend some assistance. I have had almost 1000 ebay transactions without a hitch. Always felt kinda lucky, but normally dealt very high end cards, so you miss a lot of the crazies in that world and tend to deal with a lot of the same folks. That being said, I sold a PSA 59 Mantle on ebay for $2200. I sent the buyer the wrong cert card. Seems I had already sold the one that I had a picture of with the listing. My screw-up, I offered a reduced cost but he wanted a refund. I made my apologies, and immediately refunded his $2200 plus insured shipping money for the return trip.

That was 3 weeks ago. Nada. Won't return calls, no return emails, nada. I have his home number and his wife will answer, but have not brought her into this. I talked to him over the phone when the initial screw up was discovered, and he sounded 55-60 years old, legit, informed....

I have filed the proper BS with ebay and paypal, but this is not feeling right. Thoughts?

    Doesn't sound too promising to me. I would have also offered a refund but would have waited to receive the card back. I hope this works out for you in the end.

    Presently you are entirely at the mercy of the buyer. Post the auction info and buyer ID. With any luck he'll be a respected board member and the inquisition may be able to convince him to do the right thing.

    The seller should be able to show he sent the item. The buyer will also have to show he returned the item. The seller will show he refunded. Paypal should get involved and go after the buyer. This sounds all trackable except for the buyer has not provided anything.

    Not to pile on but; you are selling $2200 Mantle's and sending the wrong card? My answer is he is making you sweat a little bit on purpose because in reality you should sweat a little; but not get ripped off.

    Of course it's not feeling right. It's been 3 weeks, and this person has obviously been ignoring your emails and dodging your phone calls. It's time to post this person's ID here, say something to the wife and perhaps even go have a talk with your postmaster to see if this situation would qualify as mail fraud.

    Mail Fraud

    18 U.S.C. § 1341 provides:

    Whoever, having devised or intending to devise any scheme or artifice to defraud, or for obtaining money or property by means of false or fraudulent pretenses, representations, or promises, or to sell, dispose of, loan, exchange, alter, give away, distribute, supply, or furnish or procure for unlawful use any counterfeit or spurious coin, obligation, security, or other article, or anything represented to be or intimated or held out to be such counterfeit or spurious article, for the purpose of executing such scheme or artifice or attempting so to do, places in any post office or authorized depository for mail matter, any matter or thing whatever to be sent or delivered by the Postal Service, or deposits or causes to be deposited any matter or thing whatever to be sent or delivered by any private or commercial interstate carrier, or takes or receives therefrom, any such matter or thing, or knowingly causes to be delivered by mail or such carrier according to the direction thereon, or at the place at which it is directed to be delivered by the person to whom it is addressed, any such matter or thing, shall be fined under this title or imprisoned not more than 20 years, or both. If the violation occurs in relation to, or involving any benefit authorized, transported, transmitted, transferred, disbursed, or paid in connection with, a presidentially declared major disaster or emergency (as those terms are defined in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5122)), or affects a financial institution, such person shall be fined not more than $1,000,000 or imprisoned not more than 30 years, or both.

    I have done business before with Beanball and the service has always been top notch. He has high end cards.

    Unfortunately all the buyer has to do is claim he returned the card. Tracking would not be needed or required because the refund didn't follow PayPal procedure for refunds. The sale occurred on July 31st. You seem to have a lot of cards. Are you sure he didn't return the card and you simply forgot it came back. The reason I ask is that you relisted the same card with the same cert number on August 9th and then ended it shortly after. The sale and return would have occurred during the National so if you attended the show you would have had a lot of things piled up when you got back.

  • I actually got the card back today. Seems he was being a jerk. I shall relist soon and this time with the right scan. Thx for the advice.

  • I feel pretty lucky on this one. Was in such a hurry because it was my fault that I lost track of common sense. One of my first senior moments. 10 years of Ebay and its still an adventure.
  • IMHO, unless you can handle losing $2000+ in cash or a card, a card of that magnitude should be consigned to a consignor/auction house. Takes a lot of the headaches and heartaches out of the equation...
    Next MONTH? So he's saying that if he wins, the best-case scenario is that he'll be paying for it two weeks after the auction ends?
