Seller has a 14 day return policy. Will this statement in his description, "Return Policy: Return MUST be done within Fourteen (14) days of receiving purchase ONLY if NOT as described," hold up if seller wishes to return for any other reason. I say Ebay will side with the buyer. What say ye?

I am extra peeved at Ebay right now myself. Had an out of country (USA) buyer start the claim process on a medium value coin ($70) which I sent regular/uninsured airmail ($3, what he paid for) rather than as a small packet ($8 cost, $100 insurance, no tracking #) or with a tracking number ($19!!!). He started the claim process before the letter could even have physically arrived. Ebay instantly ruled in his favour due to no tracking number.
I had basically written off the coin as soon as he started the early claim. The kicker- and why I am so peeved- is that Ebay will not refund my FVF ($5.50 or so). Because I didn't refund the guy's money before Ebay ruled on the case while the case was open (for less than an hour after my response to his request for a refund), I am not only out the money/coin, but also another ~8% for "selling" my item on Ebay.

I have seen sellers sneak in a disclaimer lately that says 14 days return policy(less shipping) i don't think it will fly
I think ebay would say 14 days from the day it arrives, it hardly seems fair to minus out shipping time when it could take a week to arrive.
<< <i>Agree with you, derryb. Sounds like a way to try and benefit from a return policy (via discounts) while trying to really not have a return policy. >>
True, now some are saying in description no returns on TPG or certified coins. EBay will still make them honor 14 day return.
eBay is as close to a Dictatorship as there can be. There are other sites, but for some reason they just have not caught on. Why, I have no idea. Some of them are pretty darn good...eBid & wensy to name a couple. But the bottom line is if you truly want to sell anything of value, it is where you'll get the most exposure and (hopefully) a market value sale even after the fees.
Also notice some sellers that offer refunds have a high "restocking" fee.
Wonder if ebay allows them to enforce it when there is a refund.
Anyone dealt with a return that involved a restocking fee?
