I hope that this is a dealers billing error. Update 5/8. Phooey!

I just ordered an item from the website of a dealer in one of the few states of the Union which have no statewide sales tax. I'm not a resident of the state, and they have no nexus in my state, but they charged me the sales tax rate for my state of residence. image

I've been informed that this company established an office in N.Y. in 2010. It certainly has been kept under the radar by them. image

  • About a year ago I had a seller charge me tax on an invoice (different state).......I called the seller and they re-invoiced me with the proper amount......maybe their system is just set up to charge tax

    my whole take on the "internet sales tax" stuff is taken from the days of mail order.

    if a company has operations or the HQ or something in that state and the product goes to that state, I can totally see the state expecting sales tax.

    However, going into a state where the company has nothing in it seems like "mail order" and no sales tax for either state should be charged.

    Buyer is expected to determine sales tax and remit it to his state when filing taxes.

    There is no use tax due on interstate delivery of merchandise, unless the state of origin and state of delivery have an existing reciprocal agreement. To the best of my knowledge, there is no such agreement between New Hampshire and New York.

    Theres more to it then that, say for instance the coin in question is shipped to new york from new hampshire. The buyer is required (doesn't mean people do) keep track of the purchase and pay New York Sales Tax on the purchase does not matter if the state has agreement what matters is New York charges sales tax on purchases. If its the other way around coin is delivered to New Hampshire no sales tax is due. This has been a very grey area that for the most part has been ignored by the sellers and buyers. That is why the amazon.com issue came up where they wanted amazon to keep track of this and collect all sales taxes, where they usually only collect from purchasers in states where they have a physical presence. Reason being is most people don't report these purchases and owed taxes being its really up to the purchaser, its like taking cash payments on sales made between individuals. Profits are suppose to be reported but it hard if not mostly impossible for the IRS to keep track of or prove, and usually only people bringing in a lot are targeted due to the amount of tax money involved.

    Edited to say unless you have a valid resellers license in New York ( if you live there) then no tax is due on your purchase in either scenario if buying for resale.

  • Actually what I have found.......On coins or US currency there is NO tax due........In Illinois coins & currency are exempt from tax as long as they have official status as US C&C........you might check your state statutes and be surprised

    Well I don't know does NY charge sales tax on coins and currency? They have an aggressive stance on use tax now.

    Your edit answers your question and it's legit.

    I once had an Ebay dealer tell me he has to collect sales tax for my state. I said I'd pay it if he sent me proof that he actually turns the sales tax over to the state, such as copy of his last tax submittal form to that state. He refused, so I cancelled the transaction. Some unscrupulous sellers try to collect extra money under the guise of out of state sales tax. Buyer beware.

    Since the company has done nothing wrong, why not say who they are?
    You certainly aren't being negative towards them, so you aren't harming them, and since you were surprised, others may be as well, so it may be a good thing to mention who they are.

    I've been told I tolerate fools poorly...that may explain things if I have a problem with you. Current ebay items - Nothing at the moment

    It was posted both here and on the PM forum that APMEX started charging sales taxes in NY state because they got an address in NYC.
    Don't know if it's the same company the OP bought from.
