    With the lost licenses and those lawsuits pending, I would think Topps or more likely Panini will be on the phone to UD very soon.

    Interesting premise there. If the expiration on the redemptions isn't visible from the packaging - in this case the box of the wax case - they are definitely on the wrong side of consumer protection laws. This is just a small claims case won on a technicality but this could have some reverberations...

    Agree with Vito...they have about 1.76 million in pending lawsuits from NFLPA and MLB. Expect to see UD claim Bankruptcy very soon if they dont sell. I think this is only the tip of the iceberg what issues UD has to come.
  • I'd be surprised if Upper Deck files for bankruptcy or is purchased by Panini or Topps.

    Even though he doesn't have the best reputation, Upper Deck's chairman Richard McWilliam is a shrewd businessman. He owns and or is involved in numerous profitable businesses outside of Upper Deck that are able to help him weather the issues the company is going though right now. An example is Jet Source, which is a very profitable air travel company for elite individuals.

    Another thing I'd keep in mind is that as long as Upper Deck has been around, their way of doing business when they don't agree with something is to drag things out and then let the courts have a final say on things in hopes that the plaintiff will give up, settle or lose the case. It's why if you read any article about Upper Deck being sued, one of Upper Deck's many in house attorneys that deal with lawsuits on a regular basis will be asked to comment on the case.
