Issues with seller from The Bay. Your input and feedback would be much appreciated!!!

Happy Hump Day Universe!!
I am fairly new to posting to this forum, but I have reviewed a lot of situations regarding buyer-seller issues on The Bay and it seems like people share openly about positive situations (cherry-picking) and negative situations (bad buyers/sellers). I wanted to share my situation with y’all and try to get some feedback. I’ve never really been in this situation before and I am hopeful that I won’t ever be again, but with proper feedback, I just may adjust my reaction accordingly. I am giving you a bit of a play-by-play and stating facts, allowing you to form your own conclusion(s).
So here’s the deal. On 01-15-2012, I got what I believe to be one heckuva deal on a Edgeview holdered bullion 25th anniversary eagle, graded 70. Here is the auction listing:
http://www.ebay.com/itm/ws/eBayISAPI.dll?ViewItem&item=290656997766&ssPageName=ADME:X:AAQ:US:1123
I paid for the item in less than 24 hours and received this correspondence from the seller, along with a request to cancel the purchase:
Dear simplyaaron,
I am really sorry about me and my wife selling the coin, but we have been seperate the past few days and was not communitcating too well, I sent a cancle auction, once again I am sorry.
Thank You,
Tyler & Briana

So I gave it some thought. I figured it’s possible to make an honest mistake like this, but in order to be diligent, I reviewed the sellers other feedback(s). Turns out, the seller had reportedly sold a Platinum eagle, posted with what the buyer reported to be 12 photos and the seller claimed to not have the coin. The feedback listing is as follows:
Received refund when seller claimed they didn't have coin, just 12 pics of it.
Item #290639776682
So after giving it a little more thought, I replied:
Come on, now, this is ridiculous. We both know I got an excellent deal on this coin. I want you to send it. I have paid you and I decline your offer to cancel the sale.
- simplyaaron
So apparently, the wife replies:
Dear simplyaaron,
cmon cancle this. We dont have any of the sets you can look at my feedback and see that.
pleaase cancle,
briana
And then I get this message from the seller:
If I had it would be a great deal for me but my wife sold it and I would have made $25 at 110 but my wife sold it yesterday at 3 am to a person as a compleete set beleive me I know if I take a loss on a coin or item thats the way it goes but I dont LIE or try to be a scrambler on my items with my clients.
Sorry For the confussion but I will send back the refund.
Thank You,
Tyler
So at this point, I notify ebay of my plight. If I am not going to get my coin, I at least want to get my money back and I wanna make sure there aren’t sellers on the prowl who are listing items and then: 1) backing out when they don’t make enough $$; or 2) Listing items they don’t actually have for sale.
With the buyer protection and all that, I am not necessarily worried about not getting my money back and although I am not made of money, $110 isnt going to break the bank if it takes me a little while to get it back. After more than a week, I still haven’t received my coin, I haven’t received any refund, and I haven’t heard from the seller, so yesterday, I went ahead and left some feedback that I believe to be appropriate:
“seller claimed to not have coin. Look @ feedback- seller has done this before”
And finally, this is what I just received today…
Dear simplyaaron,
dude can you not see I just put in a tracking number I tracked you 1 down and lost 50 dollars, your welcome it'll be shipped out today thanks for the shotty (the word "shotty" had an I in place of the o) feedback I'll be sure to leave the same for you

So .this is where it stands. I thank you for following this series of events and I openly welcome constructive and critical feedback.

Hopefully you'll get the coin. If not, file ebay and paypal claims.
And by the way, welcome to the board!

Not sure why people get so tied up in getting that awesome deal/rip. To me, some things just aren't worth it.
Too many wierdos out there and you never know what could lead to what.
I've been told I tolerate fools poorly...that may explain things if I have a problem with you. Current ebay items - Nothing at the moment

My biggest problem with eBay is the second chance offers. (I guess there are more) You put a decent bid on a coin and someone runs you up and then they cancel their winning bid and you end up with a second chance offer at your max bid. I think that if the winner backs out then all of his bids should be back out completely. I countered offered the seller at his starting bid (89.95+ 2.95 S&H) since it was only the 2 of us bidding. He replies with my max offer (100.00) with free shipping. We were $7 apart and I did not budge, although he complained the it was ONLY $7, and how he was just trying to make a living, His FB score 14,000+ over 10 years, myself 250 FB's and almost 3 years. I truly believe he DOES know how to play the game and I was new. I should of email him that he let a customer walk away for only 7 bucks. But I think I got him back as he relisted the coin and I did bid on it but only to $87.00 and this time he gave free shipping. So I know he watched me bid and then go away and it sold for $87.00. I made sure not to over bid my offer to him. But I did want him to know I am watching it. I just hoped that nobody else wanted the coin.

Happy Collecting!!!!
Hopefully that happens. Clearly someone to stay away form in the future

<< <i>Hey, thank you everyone for the positive feedback. From the looks of things he did find one and send it. I agree with you Bochiman, as far as moving on. I guess I am just frustrated with the idea of letting this slip after it seemed to happen to someone else already. Hopefully, this will never be a problem for anyone ever again. This forum makes the bay a better place, one outed buyer/seller at a time. I'll live to buy another day, but never from this seller. Thanks again, y'all.
Happy Collecting!!!! >>
Once you receive the item, I hope you withdraw the negative.
Have you checked the tracking number?? I am just curious if it was a legit number....
I have completed positive sales and purchses from the following members:
jclovescoins, dpoole, dmarks, guysmiling, Ducky1100 , piecesofme, ericj96 ,Classof67, ModernCoin, MrOrganic, 53BKid, nychad10, GUINZO1975, derryb (3 times), PinkFloyd
Regarding the feedback, I think what you did was acceptable since you waited one week for your refund
and there was no word from the seller. If he was sending you the coin then he should have informed
you of his plans.
good luck.
<< <i>You might want to video tape yourself opening that package if you get one. Might not be what you wanted, might not even be a coin.
good luck. >>
That does zero good. Buyer could open it from the bottom prior to taping, and place sawdust in there.
