Check out my Custom 1/1 Canvas Masterpiece cards

My first batch of 1/1 Canvas Masterpiece cards are done. They turned out even better than had hoped. I have about 15 more done as well, I just haven't had time to photograph them.

    I do have to ask though, is this legal? I kind of assume you already checked into it and know it is.

    I know I've seen all the sketch cards and what not, but those are physically drawn - yours are printed. I don't know how that area works.

    I really need to stress I'm just inquiring I'm not trying to start anything.

    I don't know for sure but I was always under the assumption that if you weren't making money off licensed/copyrighted material than it was okay. Or it least you wouldn't face much of a threat of being sued.

    Yeah... But by it being an auction it kind of looks to me like it is for profit that is why I asked.
  • I admit, I am a bit fuzzy on what I am really allowed to do. I have seen on eBay a lot of custom made made cards for sale that are way more blatant when it comes to Copyright violations. Using actual photographs taken from the internet, and using team names etc.

    Now, my cards do not use the team names and the team logos I have made sure stylize etc. And all my cards use my Original artwork. Now it is true, my artwork I have created on a computer and have not hand drawn, but I am not sure that makes any difference, Artwork is artwork. I am doing this because I like to do the artwork, and I thought making cards out of the artwork would be a fun way to "share" my artwork with others.

    I am not sure why my artwork is any different than somebody who paints a picture of Mickey mantle and then has prints made from their artwork and sells that, or sells the original for that matter.

    I think I will probably stop making cards of current players, as they are probably protected under the MLBPA. But I am also not sure if they really care about somebody making a handful of cards. I am not making thousands of these or selling them as sets or in packs etc.

    I definitely don't want to get into any trouble, I just love doing tis artwork, and have had a great response from people who like it as well.

    Maybe I will just do the 1/1 canvas cards. There are thousands of "Art Cards" being made and sold on eBay.

    Honestly you would probably have to speak with a lawyer to get a definitive answer.

    Good luck with whatever you end up doing.

    I think the ones you posted in this thread, with only an image of the player and no name etc would be good, but when you are making "sets" and "limited editions" and putting the name on their I was kind of worried (for you).

    Short story:

    Years ago, myself and a friend were creating custom decals involving Harley-Davidson, MLB, NFL, NBA, NHL, NASCAR, and NCAA team logos. Just simple decals that were selling for about $5-$15 each. We were listing over 300 auctions per week, making a small killing over a 6-month period. The first cease and desist letter came from HD, followed by MLB, then the NCAA, then the NFL (nothing from the rest). MLB were the only ones who asked us to submit a portion of our profit to them, or else we would be sued. I forget how much we had to give them, but it was about $1000. We complied and stopped making them all together.

    Moral of the story... it may not happen today, it may not happen tomorrow, but it will happen.

    It doesn't matter if the person is covered under the MLBPA or not - it's illegal to sell their likeness without permission. You can get away with it with people like Abe Lincoln or whatever but Mickey Mantle and other 20th century figures, you're looking at some hot water if their estates find out. Same deal with living people, too.

    Not to mention all the MLB logos in the cards you've posted here.

    They look great, just not a good idea to sell them.
