Paypal claim thoughts

Last month I bought a set on Ebay. Before I paid for I sent a message to the seller saying that I would be paying with Paypal the next day. He writes back (to my email, not through Ebay) that the set didn't sell for enough to cover Ebay, Paypal, and shipping fees so unless I paid with a check, he wasn't going to send the set. This set was close to $40K, and I didn't trust this seller one bit. In another email he sent me he said he didn't even have the set, he needed the money from me to go and buy it. Needless to say I backed out of the deal, called Ebay and explain why I wasn't going to pay and thought I was done. I got an email from Ebay saying this guy requested my personal info, so he got my phone number. He has been calling and texting to harass me ever since. This brings me to my thought about Paypal claims. This guy has told me that next time I run an auction on Ebay he will both bid and not pay on some items and also file false claims against me. You know a guy like this would have no problem filing a claim and sending back an empty box. I'm thinking in situations of claims on Paypal, the buyer should have to send the item back to Paypal for inspection, before any money ever gets returned. Paypal can then send it back to the seller, after they have verified it is the item in question. Since they have the power to take your money and freeze it, or give it back to a buyer, shouldn't they be a little more involved in the dispute.
From what I can tell, 707 is the DOLLAR STORE compared to deans_cards. For what that guy charges, if I ever bought anything from him I would expect it to be delivered to me in a frickin' limo.

The cards weren't even in penny sleeves... much less top loaders, card savers or a plastic case. The cards were shipped 1st class for $1.88, and were in EX or EX+ condition. I contact the seller(through eBay) explaining that I'll be returning the cards(he has 7 day return policy) for a full refund and I ask for an address to send them to. A little over 24 hrs. goes by with no response from him, so I file a claim with eBay buyer protection. Within hours, I have a refund and a response from him saying that he wasn't the one that shipped these because he wasn't home last week and that it'll never happen. Give me a break dude... to beat it all, he has over 3500 positive transactions with 100% feedback. My situation is minor compared to you but I feel your pain. I would save all the texts he sends to you as evidence of harassment. >>
So even though you got 40 cards from 1963 completely free you are unhappy? He made a mistake and rectified it (You said full refund), I see no reason to be unhappy with more than you started with.

25% isn't a bad surefire return, especially on 40k.
I don't know what the situation is currently (unchanged from yesterday?), let him know that you are still interested in the set but will no way be fronting that kind of money (Who would to some random guy on the net)
