With...if you change it to Topps. I wouldnt concern myself with copyright on such projects. I dont imagine you printing 1000s or the like to turn Topps head and as far as that goes, the style itself would fall under the copyright.

I think the one without the trophy looks better. The crop seems more authentic on the left one, and the trophy draw too much attention to the fact that it's not real. It seems too bright somehow. It looks like it's floating on top of the card as opposed to being part of the card IMO.

I prefer not to use the word Topps (or Bowman, etc.) on my custom cards. They are not Topps, etc., creations and it is one way to avoid confusion down the road as to whether these are "real" cards. And I don't print "thousands" of my cards. Typically I print only a single sheet of 8-9 cards, and two of those go into my permanent archives.
I believe the Gaedel cartoon is from the '76 Dennis Eckersley card.
While it doesn't show on these pictures, since I posted these, I've slightly blurred the edges of the trophy to more thoroughly integrate it into the pciture.
The expressed preferences are currently running 14 "with trophy" and 10 "without".

Echo, I think the 1 is missing, he did have over 400 at bats that year, unless of course that is wrong too.
