Oh man, I'm mad!

If you were me, how would you approach this?
Sold a card and shipped it out early May with DC. Apparently it was never scanned as it
only says electronically accepted. To this date, it still says that. Amount is not an issue.
After 3 weeks, buyer says never got it. Waited another week and I told buyer I would refund
but in the meantime I'll send some stuff to make up for the headache and hassle. I receive + FB,
and also refunded.
Of course tonight, I see my card up for auction. It ends tomorrow night. At first glance, I thought the serial # looked very
familar in the gallery pic, and scrolled down to the description and the serial # is listed in the description for what is being
offered. It is a different ID, but I checked my old receipt and both cities and state are the same. This is the seller's ID
selling my card, and how nice.....he owns a store too. So I went to an older buying name of mine and bid on the card
and sent a message asking if it was the exact serial # card being offered.....i signed it .....not my name of course.
So what do I do now? I can see if he has a conscious after i win the card to just pay me back what was owed. Man, I should
just ask for the stuff I sent extra as well. I can leave a neg. I can destroy all his auctions. The possibilities are endless.

What I would do is make sure you win the auction and once the card is shipped to you make sure you open a Paypal claim saying it was SNAD and that you got either an empty box or something completely different. Neg the seller when it is all said and done.
pay for it (whatever the cost)
Go through paypal file SNAD and if that doesn't work you can always do a CC chargeback.
SNAD makes it so you get to send him "the item" (sometimes an empty box, and probably in this case/what you are sending back)

I agree with this post. In the world of karma and morals. That card is still yours no matter how you shake a stick at it. Definitely get your card back and make the seller pay for being a scamming crook.
The guy needs to learn a lesson.
buy it. pay and make sure you change the return addy in case he recognizes it (note when you pay with papal the notice will say..such and such sent you $)
so it needs to be from a different pp account if you sent the item with your known addy on the package. I think that two accounts with different naked of the ebay id will still be sent as name of owner of the papyal account. Someone verify ths. You might need a friend to help you with this.

your other route would be to call pp/ebay and prove he did recieve the card and get him bammed.
Going the 1st route gets u into the same boat as him. He will be watching for that card.
In either case after u should share his ebay id

Obviously he got a good deal before the Stanley Cup.
Oh, I almost forgot. His buying ID is freekinwilly which you may want to block.
If he doesn't pay you or ignores your email...then send him another email with a link to this thread...I would say then he should definitely pay you.

My dog vomits too. Ah... old dogs. It's strange though that you sold it for $18 and now it's close to $90. I know you're bidding it up, but so is someone else- unless the seller is shilling.

I'd just confront the seller and see what he says.
Just a note of caution, be careful how/what you bid on and what communication you have with this sleazeball as if he goes to E-Bay first with veiled threats from you and can tie it to your current bids! Bingo you are the one instantly in the wrong !!! Seriously, this is what gave me a week timeout 2 years ago along with having to manually re-list 1200 auctions. I think your best bet is to contact E-Bay ASAP and get them involved!!

I went out of my way to send extra items and you took advantage of the situation. So now, you're selling stolen property. I would appreciate it if you send me $20.50 to slabbedgems@aol.com and do it as a gift so I won't incur any fees for my time and trouble. You can keep the extras I sent you. I don't need this to get ugly and you can save yourself the embarassment and we can just move on. I have copies of everything including print outs of your auction and mine. If I have to get ebay, paypal, the post office for you using their venue for your fraud, and every cardboard trade forum to discuss your practices, then I will. I have a couple of friends that actually visited your store to buy some vintage, and they may not do so anymore. So, I'll leave it to you to do the right thing.

But even if he pays you, I agree with powderedH20 - find several other .99 items in his store to purchase and neg him on.

Agreed. Photoshop can make you look twice. Maybe Mullins has skin in this one.

Still no response from seller from my selling ID.
He did respond to my buying ID confirming that it is indeed 416/999.
I doubt he would ever send me back the card. It's about a $40 card now and it will settle back to
$30 once all the rage dies.

Based on his attitude towards those who disagree with him (see above) his honesty appears questionable and I would think a positive outcome to be unlikely going the nice guy route. I would assume this should be a verifiable case of mail fraud. You'd think eBay would take this seriously when the evidence seems quite definitive. It would be in their business interest to pursue this from a legal standpoint if there are options available to them. That being said, we all know dealing with eBay customer service is like banging one's head against the wall. I'd try to burn the guy, legally of course; you're certainly not the first nor the last to be taken by this fellow.

EBAY has no liability here. They can/will do nothing to help the OP.
In fact, as previously noted, if the OP gets too aggressive with
the THIEF, EBAY will side with the THIEF and punish the OP.
