need help on ebay claim

I purchased a 1933 Goudey Sports Kings Babe Ruth raw on ebay. The seller described the card as Authenitic, Not a Reprint!!!!!!!!!!!

I just received the grade back from PSA and it came back N5 Altered Stock. Do I have a claim against this seller?

I'm not 100% sure if you have a claim as PSA did not come back with questionable authenticity only that the card stock was in some way altered. I would think if it were a reprint PSA would have noted it as questionable authenticity.

Edited to add: Here is PSA's description of N4 & N5

N-4 Questionable Authenticity - This is the term used when a card is counterfeit.

N-5 Altered Stock - This term is used when the paper stock is altered in one or more of the following ways: Stretching and trimming, recoloring and restoring, trimming and recoloring, restoring and trimming, crease or wrinkle is pressed out, or gloss is enhanced.

I dont think you do. It actually is an authentic card. He made no claim the card would grade.

IIRC, Brian is in California, where sale of altered sports cards without disclosing the alterations is specifically illegal. It might be worth a try to assert SNAD on this one or fight it to the credit card company, especially as ebay is in CA.

Thanks for the info. I am waiting to hear back from the seller. Hopefully he will refund my money, but it does seem that he is in violation under California law. I hate to go that route.

The card doesn't look fake to me. However, he guaranteed it will grade and it did not. Honestly, if it were me, I would get a 2nd opinion, but I know that can get rather expensive, especially if SGC doesn't slab it (and I have my own personal beef with SGC - details coming soon).......but as it stands now, he should refund if that is what you want!
