eBay CASE resolution question

I shipped an item to Canada using the flat rate box but as soon as I shipped it I realized I did not have deliver conformation on it. The item was for $300. The buyer stated they never received the item and now I have an eBay CASE against me an it looks like I will be giving the user a refund.
I have a receipt from the post office but my guess is since I don't have a tracking number it's a free window for the buyer to get a refund, even if they did receive the item.
Since I'm already screwed if I give a refund (which states I'll receive back my final value fees) will the user no longer have the ability to leave negative feedback? So at least I won't get double screwed.

BTW, the tracking # on the Customs form may say delivered also. If it does your "buyer" may "find" his item if you point this out. Although for items over $250 you need signature confirmation to CYA. You may just luck out if you act like you know what you're doing and your buyer gets the hint that you might not be in the mood to play.
It is amazing what people remember getting when confronted with the knowledge that the package was delivered on wednesday, March XX.

You don't win because paypal isn't in it for the seller, they can send you an empty box back with DC and get their snad claim

dc for items below $250 doesn't always protect the seller, I shipped a card registered mail to germany and its taking its sweet time to get there and the buyer opened/won a claim even though it had a tracking number.
Even if the Customs # was acceptable to PayPal - which it
is not - the $250 rule would still apply.

If still in the process let your ustome know and let him think that you got the info from the PO. It makes it look like that they are tracking it's status.
The buyer already put in a claim (they know they can screw me over) and I do realize that I will still loose this case if the buyer wants to be an a$$ about it.
I blame eBay in part.
Before any person sells an item they should be taken to a form that states in big bold red letters that if you don't ship using a certain method the buyer can simply fill out a claim and get a full refund no questions asked. You should than be forced to agree to these terms.
I believe that the seller hasn't received the item yet. But since they put in the claim they can simply collect their refund, and receive the merchandise in the coming days.
I don't think I'll ever ship to an international buyer again.

very true & very expensive just shipped an item to Finland Global express 4 1/2 pounds with insurance $139.45 ouch and guess what? it has went from Cincinnati to Erlanger to Memphis to Great Britain to France to Denmark to Finland and now it reads:
Clearance Delay, April 01, 2011, 2:05 pm what ever that crap means? customs just checking out the neat hockey cards. oh great.
it also took 45 minutes at the post office for the clerk just to figure out how to ship it & insure it. you would think I was a terrorist with all the crap I had to fill out. and the clerk still had to cheat and claim it was greeting cards for it to clear. wtf
EMI is the best/cheapest international method.
GXG is more expensive and the "time certain" guarantee is
a little stronger.
Both are PayPal compliant.
The mail carrier will pickup at your home/biznez.
EMI gets an 8% discount, if paid online.
GXG gets a 10% discount, if paid online.

Shipping internationally with PayPal in the mix is just not
worth the trouble/risk, unless EMI or GXG are used.

PayPal ONLY cares if the item is RECEIVED by the buyer.
If the seller can show online proof of DELIVERY, he is protected;
less than $250, DC; $250 or more, SigCon.
That an item was mailed and got stalled in transit means nada
to PayPal.

EDIT ADD:
Using Registered Mail on International shipments is an invite to
a successful/fraudulent INR claim.
EMI is the correct solution, because it is FAST and offers less
chance for negligence/theft by the USPS/Customs.
