Creator of the Liberty Dollar Convicted

STATESVILLE, NC—Bernard von NotHaus, 67, was convicted today by a federal jury of making, possessing, and selling his own coins, announced Anne M. Tompkins, U.S. Attorney for the Western District of North Carolina. Following an eight-day trial and less than two hours of deliberation, von NotHaus, the founder and monetary architect of a currency known as the Liberty Dollar, was found guilty by a jury in Statesville, North Carolina, of making coins resembling and similar to United States coins; of issuing, passing, selling, and possessing Liberty Dollar coins; of issuing and passing Liberty Dollar coins intended for use as current money; and of conspiracy against the United States. The guilty verdict concluded an investigation which began in 2005 and involved the minting of Liberty Dollar coins with a current value of approximately $7 million. Joining the U.S. Attorney Anne M. Tompkins in making today’s announcement are Edward J. Montooth, Acting Special Agent in Charge of the FBI, Charlotte Division; Russell F. Nelson, Special Agent in Charge of the United States Secret Service, Charlotte Division; and Sheriff Van Duncan of the Buncombe County Sheriff’s Office.

    This is not intended to be a political post. Given recent posts about states wanting to create their own silver and gold bullion coins, this would seem to put a damper on those plans.

    I always found it interesting that the only thing you could pay him with was US dollars. He wouldn't take his "Liberty" money.image

    How's this for irony? The Coin World issue just released details a Ron Paul proposal that would make private minting legal, in addition to several other provisions that address bullion and other precious metal coinage.

    During the 1849 California Gold Rush, according to the Coin World article, anti-counterfeiting statutes were put into place because "the private mints were eventually accused of circulating debased (substandard) coinage, and with the supposed aim of providing government-sanctioned regulation and a government guarantee of purity, the 1864 Coinage Act was passed, which banned private mints from producing their own coins as currency."

    Imagine my shock and surprise!!!!! DEBASED COINAGE!!!!! The outrage!!!!!!!

    Yeah, we wouldn't want those subversive private minters to start pumping out debased coinage made from .999 silver or warehouse receipts that are actually backed by real metal, would we?

    I hope that Ron Paul's proposal gets some additional sponsors. We shall see.

    Can anyone clarify whether the Liberty Dollars were silver, or were they some base metal?

    If they were base metal and calling them a "dollar" then you can understand why the Feds are upset - that is counterfeiting plain and simple.

    Did he get in trouble for making them or for trying to tell merchants they were a new type of money? I remember seeing him on youtube videos go into stores buying stuff and telling an unsuspecting cashier that the $20 coin was a new type of money and talk them into taking it. That's deceptive and illegal.

    The jury heard all the evidence from prosecution and defense. Further, as this was a criminal case, the standard for guilt was much greater than in a civil action. (Think back to the OJ Simpson trials.)

    Interesting how quickly some appear to reject the jury’s verdict when it disagrees with their preconceived notions and biases.

    For all of its idiosyncrasies and shortcomings, the independent judiciary and availability for jury decisions is a lot better than summary judgment by an “official.” (It reminds me of the suspension of rights in Hawaii during WW-II and the dictatorship of Col. Green and his Army buddies in the JAG’s Office. Accused of a crime? 15-minute “trial” and 5-years in jail…no defense, no jury of peers – nothing.)

    It depends on who decides what to prosecute and what not to prosecute as well. There are so many past and present violators of various criminal statutes in Congress and Washington DC that never get charged, it's no wonder that a case like this is viewed with more than just healthy skepticism.

    The case should've never been brought in the first place.
  • What surprises me is how quickly the jury returned; less than 2 hrs! While the charge of making coins of gold/silver intended for use as currency (18 USC 486) is pretty obvious, I expected them to at least spend a bit of time on the counterfeiting charge since none of those coins look much like actual US coinage.

    He most certainly would!

    You could exchange 20 $1 Liberty coins for a $20 Liberty coin at anytime you wanted.

    I decided to change calling the bathroom the John and renamed it the Jim. I feel so much better saying I went to the Jim this morning.

    Look it up and then post it please instead of passing what amount to a "I remember this or I remember that" rumor.

    I don't believe he ever did this unless he was trying to get a store to join his network of Liberty Dollar stores that accepted the coins for their bullion value in which case the entire philosophy behind what he was actually trying to do was explained to them in full. (i.e. sans deception)

    Maybe he can get a pardon in 40 years, like that guy who was convicted
    of "coin mutilation" in the early 1960's.
