Interesting reply from Ebay seller

I purchased a couple items on February 6th that haven't shown up. Sent a message on March 2 that I had not received them. He responded that they had been mailed but he did not have a tracking number. I sent another message yesterday to let him know they still had not been received. Here's his response, obviously not meant for me:

    Tell him "Yeah your right " Now Ya Donna forced me", your getting a Paypal Dispute for Non Delivery and your Getting a Neg!!!

    Do you want the item or do you want your money back?

    He obviously meant to forward that to somebody instead of reply to you. Personally, I would reply back saying that you think this is meant for someone else. If you don't, that will just delay everything even longer. I would also check his feedback, his seller history, and what he's sold recently to see if there are any glaring red flags. I would also tell him that you need the items and a tracking number asap since it's been over a month. I would also dispute the item immediately. If you ask for the refund or for the item in your dispute is up to you. Asking for the item will delay a refund, but if you ask for a refund, then he will almost definitely not send the item. No matter what, make sure you leave appropriate feedback. If you get the item, nothing above a nuetral. If you don't get the item, then a negative. Remember, he has tied up your money for a month and will continue to tie up your money for at least another week or so.

    Were they pricey items that would even remotely justify him selling what he didn't have? Or maybe he's legitimately pressing a partner to come up with a replacement item to send.

    hello Guido, I am gonna go to this guy's house and break his legs for not sending me my stuff you wanna come along and break his arms. LMK, gonna email him back and tell him I am just gonna stop by and pick up my stuff LOL. then I'll Neg him & file a INR get my money & cards & satisfaction.

    then email him back and say sorry that email was meant for someone else and then ask for his address as you are going to be in the area and will just stop by and pick your cards up and you got an autographed bat you want to show him. image

    Reply back hey it is me again the buyer. Pretty sure this message wasn't meant for me. Do I neg ya now and open a dispute or open a dispute and neg ya once I win it?

    So I gave this punk, ebay ID 3bandits1 , his well deserved negative. He sent "replacement" items for half the stuff I bought and never refunded me for the rest. I brought to his attention that I was still owed for the remainder of the items and he decides to ignore me. I think he thought the 45-day window had lapsed and I was out of luck. He must have forgotten that February only has 28 days. So I left him two negatives on the last day that I could with the intention of changing one when he refunded me the couple of dollars he still owed. Instead, he began harassing me on the phone. I checked his feedback on toolhaus a little closer and sure enough he has a long history of harassment.

    Take notice to the transactions on August 15, 2007, “Buyer harassed every day til seller forced to refund.” and then in September 2007 “Sent message with strong language.” What I find most interesting is the feedback on March 22, 2008, “This 18 yr old feels harassment is good business practice.” It also indicates that the feedback was mutually withdrawn. I think this means he harassed this buyer until he removed the feedback, just like he is trying with me. There are three more instances of people withdrawing their feedback. I can only imagine this was due to harassment.

    I told this guy that harassing me on phone is only making matters worse for himself and now there is no way I am removing the feedback. Yet, the calls continue. I've informed eBay of the phone calls but I don't think there is much they will do if it is over the phone. I also shot a message to his mom on facebook letting her know what her son is up to and a link to his toolhaus page.

    Any other advice on how to handle this schmuck?

    If he's that young and dumb (no offense to OUR young members, dumb or not), I'd tell him that phone harrassment is a crime and that you've contacted the Police. He'll buy it...

    On a landline - ATT - *60 will block selected numbers and
    the phone will not ring and will not go to voicemail. I am
    sure most phone companies have a similar scheme.

    On a cellphone, there are a variety of blocks available.
    Look at your manual or call customer svc.

    There is also free software that blocks VOIP, cell, and
    landlines from getting thru; you just hook your landline
    to the computer.

    You can buy a variety of blocking devices at Radio Shack;
    not expensive and they work independently of the blocking
    schemes of the phone companies. These can save you money,
    if your phone company charges an extra monthly fee for blocking.

    If you wanna shake the punk up, call the cops in his hometown
    and tell them he is "threatening and harassing" you.

    "He says he is going to get me," is usually all it takes in the new
    nanny-state America.

    If he is annoying you, I would annoy him back a little. A fun prank friends of mine pull on one another is posting a Craigslist ad for whatever (usually cheap iPhones or MfM stuff), and post his number right in the ad. If a number is posted in a few major cities, he won't have enough time to call you or anyone else to annoy them.

    My son did the Craigslist post idea to someone harassing his girlfriend over the phone. Problem solved.
