I complained a couple of years ago about this and my rep said that Australia and other countries have completely different rules. They would and could not remove the auction.

Yup, same with Ebay Canada. There's one very prolific seller that puts MS65 in basically everyone one of his coin auction titles, when the actual grades are EF to MS~62. Very annoying when I am going through my saved searches. I've reported it, but since it's on ebay.ca, all is fine and good according to Ebay
