Ebay Refund Question

I recently purchased an item and have found out that it is a fake even before I have received it. The seller offers a 7 day refund, so no issue there. My question is...can I refuse delivery from the Post office and then will it be returned to the sender, or am I stuck with having to accept it then turn around and ship it back? I'm thinking I would need DC on the return to be covered. Also, do I need to file a SNAD or do I just return it based on the sellers return policy? Thanks

    If you intend on using the sellers return policy I'd speak to him first.

    (That means I'd accept package and re ship with DC)


    If he balks you are now covered if you have to file the SNAD.

    No getting around it, you have to pay the return shipping, up front at the least.


    If you don't accept it the seller can claim he never received it back.

    You can do it either way, but in most situations, you'd probably be SLIGHTLY better off accepting it and then paying to send it back with a different tracking number.

    You don't have to file any claims with PayPal until the seller either becomes unresponsive or flat out rejects your refund request.

    If it's sent by the seller with a DC number, that number will be used to track it on its way back to the seller. I don't think it's possible to refuse a returned package that the post office returned to sender because the recipient refused delivery. If this somehow were to happen, the package would probably end up at the dead letter office, since both parties are refusing to accept it, and there's nobody else to claim it. This would most definitely be reflected in the online tracking information. So there's not really much danger in refusing the package, although I agree that if it's not a large amount of money, it would be better to accept it and pay to ship it back. But it's not a completely stupid or insane thing to do.

    If there's no tracking number on it when it arrives, buyer can refuse it and have it returned to sender. If the sender then claims he never got it back, the buyer can just file INR, since neither party will have any proof of anything.

    you should notify the seller.. and I would open a claim for your own protection.. they will have you return it
    and you will need to prove a d.c.

    I had a refund from paypal issued today.. on a seller who sold me fake goods..
    I opened a claim.. and the seller never responded. The return address on the package I found was to a vacant home
    that seller had no link to. Paypal refunded my money and did not require me to send back..

    The problem here (again) is that we do not have all the information.

    Did you pay with PP? (Yes I see you asked if you had to file a SNAD)

    Did the seller send with DC/SC (You don't know this yet)

    The bottom line is Email the seller (after it arrives) and (if it is indeed fake) see how he reacts.

    Yes, paid via Paypal. Also, tracking info shows that DC was purchased by seller. I've already emailed the seller twice...no response as yet. Haven't received item yet, but research has identified the item as a fantasy piece created in the last couple of years vs. a true vintage item as identified by the seller. No problem paying return shipping as I have some culpability in this. Should I just return with DC based on the return policy (provided he responds and says send it back)...or file an SNAD and follow that process?
  • I don't mean this as a personal attack, but this is so disturbing. This is probably the third thread in the past week where someone is asking this exact question, and it has become painfully obvious that the majority of ebay buyers have absolutely no understanding of how the dispute system works, how it impacts the seller, and when a claim should be filed or not filed. I place 100% of the blame for this on ebay for not educating their buyers on how the F to use the system properly, and then never remedying the situation when it's used improperly as a result of their negligence. UGH.

    The answer to your question is that you should accept the delivery, contact the seller and give him 3-5 days to respond. If he tells you to send it back for a refund, you do that without filing a claim. Make sure to send it with a new delivery confirmation number, and if the total original price was $250 or higher, use signature confirmation. Only if he fails to respond, or if he responds but then fails to issue a refund within 7 days of having the returned item delivered back to him, should you file a claim or dispute with ebay or paypal.

    Thankfully I haven't had to return many items which is why I wasn't familiar with the process. Ebay help didn't answer my questions either about whether to file right away or not. In any case, the seller responded quickly and politely and asked me to send it back for a full refund including return shipping. Thanks for all the input.

    Yeah, seriously. What if, by some odd chance, the guy bought the item in good faith, has no idea it's fake, and can't answer e-mail because of a family emergency? You really want to hit him with a seller dispute? Is it going to kill you to wait 72 hours? You have 45 days to file a claim, and at least 60 days to file a chargeback on your credit card. Why so impatient? If the guy is a lowlife cheat, you'll still get your money back, and if not, at least you didn't screw over an innocent person.
