It is a mechanical error that has been for sale before with similar hype that it is something it is not

That would be my guess but the coin number is wrong. 1882 DMPL should be 97133, PL 7133.
My guess is they got the Proof coin number on accident.

How do you know it is not proof and the "MS" is the mechanical error?

This coin has sold before and it was called a DMPL. This auction calls it a business strike and the images tell the story.
