How long to wait before filing an item not received claim? **Update**

So, I won an auction (E-Bay) on September 29th. Piad via Paypal on September 30th. Seller has a lot of stuff currently listed BIN/BO. Looks like he sells a few dozen items a week.

So, five days after I sent payment, I used the "contact selller" from E-bay to make sure he received the payment, and ask when he intended to ship. No response.

So, nine days after I sent payment, I used the "contact selller" from E-bay to make sure he received the payment, and ask when he intended to ship. No response.

So today, eleven days after I sent payment, I used the "contact selller" from E-bay to make sure he received the payment, and ask when he intended to ship. No response.

I checked the guys feedback, and there are a few a day from the past 14 days (all positive), some from buyers for auctions ending after the one I won. "Fast Shipping", "Great Shipping", "a pleasure to deal with", etc.

BTW - It's an $800 card. Not peanuts, at least to me.

Paypal and e-bay show that the payment was made; however, neither show the item as shipped.

I paid with a bank transfer from my checking account.

If you paid with a bank transfer, sometimes Paypal views that as an e-check and will wait up to business 5 days for the payment to clear before notifying the seller that the money has been received. You will still have a record showing "paid", but until that money is in paypal's hands, it is not considered that way for the seller. Not saying this is the case, but I have had that happen to me before when I didnt have enough in my PP balance to cover a purchase and some had to be transferred from my checking acct.
IT IS ALWAYS CHEAPER TO NOT SELL ON EBAY

Not saying that's not the case, but my account is set up with "instant transfer". Have sent dozens of payments this way and never once had one put on "hold".

start the PayPal process if not in tomorrow's mail; that will get his attention....you've been much too patient IMO (especially with no communication)

After all that and no response, I'd be putting that claim in right now

So this is uncharted territority for me.

What is the process? Is it all through Paypal or do I need to do something through E-Bay as well?

    Thanks in advance,

Just go through PP. IMO I'd wait until 2 weeks have passed before I'd file.

    You do have 45 days.

I know you have emailed him 3 times with no reply, perhaps an email that says: I will be filing a PP claim in 2 days

if I do not hear from you regarding this issue.

You're too easy!!! After the 5 days and no response, I would have been on the horn to eBay the next day. You will eventually be refunded all your money...if you have any difficulty figuring out the eBay/paypal claim process, contact me privately and I'll give you their phone number.

In the event you do get the card, I'd neg him anyway for the grief and generally angst he put you through. Sellers like this need to be banned from eBay. If you neg him be sure to state briefly why you did so in the dialog box.

Be direct with eBay, no wishy-washy, you want your coin or the card PRONTO.

For the record, from what I understand it is better to simply go through PP.

Ebay makes you go through more hoops.

So, my guess is the seller is a reader of these forums. Got a reply last night. Says he must have missed the payment notification. Apologized, and said card is going out today.

He does a lot of volume it appears, so I'll forgive him. I'm like that.

Is this a card that sold too cheap (if it was an auction)? Maybe the seller would rather have a negative than let the card go for the low winning bid.

If it was a BIN then obviously disregard my above comment.

Nam - it was an auction. I was the only bidder at the opening bid price (started at what I assume he would take for the card, a little above average). I thought someone would come in at the end but nobody did. It was an above-average card for the grade, so I was willing to pay above average price.

If the card was strong for the grade, and he started it a little above the average price, I'd say you're gonna get the card. Maybe he's just a really slow shipper, with poor customer service skills.
