I fully agree with Meteorite...what is there for paypal to "investigate" anyway?? You received a payment that was not authorized but didn't ship the product so why wouldn't you send back the money? Why even involve paypal. I'm sorry, but you seem to be creating unnecessary drama here.

Payment was authorized but by another person other than the account owner, what the bejesus would you do in that case? Red flag for me, red flag to paypal to look into it.
I don't sit on my hands and turn the blind eye if I think something is suspicious.
Trust me this guy was not cordial in his communication, everything felt fishy and I never heard from the payee until I contacted them via email.

Cordial????? All I asked was for the money to be refunded to the account it came from since you sold the cards and claimed that "the transaction wasn't going through". The money wasn't refunded on Saturday after you had promised to do it Friday evening. How would you react knowing you had just made the dumbest move ever by gifting $400 to someone that could've just disappeared with the money????

Adhere to the second sentence of your previous post, not the first...
I offer the gift option all the time, but would only do so to a buyer I trusted or had done business with before. Doing otherwise is just asking for headaches.

I was honest and up front with you and told you that I made a mistake and sent it from the wrong account and said I would take care of it on my end. You should've immediately refunded the money once you sold the cards to someone else instead of saying that "the transaction isn't going through"......
There are always ways for the buyer or the seller to rip the other person off on pay pal....gift or not. If one is that worried, one should not do internet business, in my opinion.
This however, was a completely seller created problem, akuracy503. You made a deal, sold something off eBay, which yes, most do and I personally do not care, but that is what you did. Most of us when we make a deal, we either do the deal or not....you did plan C....sell to someone else, lock up funds with Pay Pal.
Now, when you sold the item the second time....it sold for more, correct? I bet that is correct, meaning there were two problems with this transaction.....both seller created.
I also feel to even see why money being sent as "Gift" has anything to do with what happened. Would not the same thing have happened if sent normal?

After speaking with PayPal on several occasions the last few days, I was made aware today that had I not made the mistake of sending it from my boss' account and the fact that it was a gift that I would've been out the money! Thank God my boss reported the unauthorized usage or akuracy503 would have been able to keep my $400.....that would've been a major scam on his part! Word to the wise....don't gift to anyone!
The problem was that the payment came from an unknown name other than from Mr Wiseman, I immediately replied to mr wiseman letting him know that this transaction will not happen and a refund will occur.
Paypal locked the funds when I red flagged this scenario, then I emailed the original payee's email the next day.
I did nothing wrong except alerted paypal of the scenario.
Same thing wouldve happened if this was a normal transaction, again the problem was that it came from an unknown account. Unknown payee stayed anonymous until I emailed them.
Again I am not going to take action without the guidance of paypal and be held responsible for any fraudulent activity, how is that so difficult to comprehend?

Why would you contact PayPal when you were screwing them out of money??
If all of this was unintentional and a big mistake I truly apologize, I was doing my due diligence in protecting myself and others who could've run into such a scenario. Being part of a collectors community forum will win you some credibility.
If anything we all learned a lesson from this.

This is what I have learned over time with paypal gift. To protect myself when someone is asking that I pay with the gift option, see how much more it would cost to pay with a goods service.
I have payed with the gift option in the past, but just a few weeks ago I asked a seller how much more it would take if I payed by the goods service. It only costed me 7 more dollars and I felt that if I paid that amount it would cover my behind if anything went worng.
Just to let everyone know nothing went wrong, I got the cards and a great deal, but if anything did I was covered.

Ebay and Paypal bend people over on a regular basis and while I neither agree nor disagree about the entire discussion, I applaud everyone who scores one for the "average Joe" and puts it to ebay and Paypal, two of the worst business models and questionable behavior companies in history.

I understand it had nothing to do with gift....you are the one that kept bring the gift part up. Other kept repeating, that's why I dont like gift or the like. I was clarifying for others.
You never were liable. You never shipped anything. Rather you sold something, sold it again, and did not refund customer #1 money right away. I understand why you did not want to complete the transaction....that you agreed to then decided to not complete and ignore the customer...although again why you wouldnt just refund and let him resend is beyond me. However, what YOU did was on the verge of fraud. It is Dan that almost got cheated....not you. When you e-mailed Dan the transaciton would not go through (after it sold for more), you should have refunded payment at that moment.
I think you owe Dan an apology, for holding his money and for this thread.

You refuse to see both sides of the situation, I opted to not go through with Dan because payment came from another account, NOT because the item sold for more on eBay(I had two cases so could have very well covered both deals)
I asked paypal to review, they held funds, Dan got a refund, end of story.
I apologize for what Dan went through but it was standard paypal policy to hold funds in investigation.
If paypal found Dan and "boss" to have a shady account history I would be viewed differently.
