What's wrong with this auction?

Here is what I see:

1. He is using a photoshopped label to make it look like he has coins in hand. Nobody has coins in hand yet. Misleading.
2. His listing has shipping time of 4-5 days but in the fine print, he takes advantage of the standard 30 day ebay presale rule. Again, misleading and self-contradictory.
3. He lists his shipping as $4.90 and even says "you pay what I pay" but in the fine print he states that insurance will be added. So you'll get an invoice for more than the cost plus $4.90

So if you don't read carefully it appears he has coins and can ship quicker and cheaper than anyone. but none of these are the case. I think he'll have some unhappy customers...

I'll admit, I'm a competing seller but I believe I'm looking at this objectively.

    Correcto mundo.

    Also correct is that once he actually "ships" the coin it will be delivered in "4-5 Business days".
    I decided to change calling the bathroom the John and renamed it the Jim. I feel so much better saying I went to the Jim this morning.

    Being one of the first sellers of the modern coins on eBay can be a dirty, risky business. I don't know if there's anything you can do in this situation. They play with fire, they're going to get burned eventually. In the long run, hopefully, it's the people who play by the rules who are the ones left standing.
    I have existed since the creation of this world and will exist until its end. Only my form will change. For these 80 human life years, I have the benefit of having a functioning body and consciousness. I will not waste this opportunity.

    I dont play the Modern game at all, nor do I Ebay anymore, but I think if you stick with Jerry you wont go wrong. Honest , legit and trustworthy. All the points you made are legitimate.

    Incorrect. the 4-5 business days is a sum of the time for priority mail + the time that the seller chooses for when he can deliver. He has obviously chosen "1 business day". If he had accurately chosen 10 business days like I did in my auction, it would say 14 to 15 business days.

    As long as the guy delivers I dont see a problem with it. He is being up front about the waiting time. Granted if he doesnt deliver you are out cash on hand for 30 days. Only gray area is the photoshopped pic id say? Otherwise arent there B&M dealers who take pre orders like this?

    In my opinion no one should be allowed to auction anything on eBay they don't own or have yet. I am a dunce so explain to me how you can sell a graded 70 coin you don't have. Is it that easy to get a 70 or are you just hoping or are you given assurance the coins you don't have will grade 70 or did you buy them from a huge dealer that gets 70's before anyone else or what. I don't do moderns so i really don't get it. Did you already get a grade from PCGS or are you hoping or what. I am serious I would really like to know how this works.

    Nobody is forced to bid on these kind of auctions if they don't want to. Seems easy enough to avoid if you just read the description, so I don't see the need for any more rules.

    Pre-orders are something which happens with every mint product release. It happens ALL the time. It happened with each of the LP Lincoln releases. It happened with the Lincoln Proof Coin Sets. It happens with Silver Eagles and it happens with Gold Buffalo's. Just like clock work. Heck, even the OP has his own presale. It's just worded differently.

    As for the 70's? It's a gamble. A certain percentage of 70's will be awarded as 70's are ALWAYS high for these super soft gold products. Nearly every strike is perfect and if the coin can just survive the packaging process without getting any blemishes, it should get a 70. BTW, more 70's were awarded the 2009 Proof Buffalo 1 ounce coins than PR69's, PR68's and PR67's combined. Of the 3,780 PR70's graded, more than 3,000 were First Strike™ which basically means that First Strike™ PR70DCAM is the norm.

    And as with any US Mint product, high prices get thrown up against the wall. Sometimes they stick and sometimes they don't. Modern coins, are a game where you choose to play or you don't.

    It's also pretty cut throat to get those first orders out since everybody wants to get in on the action.

    Unfortunately, pre-sales are a part of the business and if you are an ebay seller and want to compete, you are forced to do them. I generally get my coins back as fast as anyone so I'd be glad to have a rule change that says you have to have the coins in hand--but some sellers would probably still fake it. --Jerry
