Ebay Seller Nonsense

I won an auction for a modern game-used patch card. Auction ended for $2.75 this morning (which was a mistake by the seller certainly to end an auction at 7am on a Sunday). The card is listed in Buy-it-Nows near $30. So, I scored a nice little win. Didn't pay for it this afternoon yet when I received an email from him trying to back out of the auction. After questioning, he claims the card was offered to someone else.

The seller has a feedback of 82 and a rating of 98.7.

I really want the card, but it's obvious he's not going to send it (whether he really did offer it to someone else, or if he just wants to relist it later and hope it sells for more).

Suggestions? This seller deserves negative feedback, but I don't believe I can do that until I send payment. The seller in his first email said he would refund money immediately if I paid.

    On EBAY - absent court intervention - there is no way to
    force buyers to pay OR sellers to ship.

  • Send ebay the email where he says he offered it to someone else. Also he'll probably try to cancel the "transaction" between you two and you'll have to approve, so don't. He won't get his listing fees back and I believe will have to pay the final value fees as well. Also after that you should be able to leave negative feedback.

    Add edit: forgot to mention don't do nothing at the risk of getting an unpaid strike against yourself.

    Pay the man.
    Since it was his mistake...he should have just came forward and said that. I and most anyone would easily let him off the hook.
    But to send B.S. is not professional.
    Email him very nicely and tell him payment will be sent (do it only via paypal to protect yourself) and results of the transaction will be associated with corresponding earned feedback.

    don't threaten negative. Word it nicely.

    If he comes clean be a sport and let him off the hook or offer a middle ground...1/2 price.
    Either way neither hets busted.

  • I'm getting conflicting comments here.

    It appears I can't do anything until I pay him, correct? The Ebay resolution center does not allow me to open a case unless I've paid.

    Pay the man, then see what happens.


    Play it from there. Do not threaten him.


    When all is said and done and if he does not send the card neg him.


    So, if he refunds your payment, neg him.

    Notify ebay of seller non performance

    One other point you can neg a person as soon as the auction ends.

    That might get ebay to squash it.

    A neg with 1 star across the board will do a lot of damage to his future sales. And he deserves every bit of it.
