Forfeiture lawsuit targets fake coins

Law enforcement authorities are suing to acquire 205 fake Canadian Maple Leaf gold coins that were seized during arrests three months ago of suspects accused of trying to sell them at a jewelry store in Kinnelon.
In a civil forfeiture lawsuit filed yesterday in Superior Court in Morristown, the Morris County Prosecutor's Office seeks to extinguish any rights to the coins that suspects David Bell, Gerald Gary and William Gary Jr. may claim.
Bell, 57, of Hillside, William Gary, 52, of Scotch Plains, and his brother, Gerald Gary, 55, also known as Hakeem Shaheed, of the Sicklerville section of Winslow Township in Camden County, were charged in September with theft, theft-by-deception and conspiracy to commit robbery at a store in Kinnelon, authorities said.
The alleged scam involved the trio going to jewelry stores and pawn shops, presenting an authentic Canadian Gold Maple Leaf coin and claiming to have more to sell, authorities said.
If they struck a deal with the jeweler, they would try to pass off fake coins as real, authorities said. In some cases, if the dealer realized the coins were fake and scuttled the deal, the suspects would then commit an armed robbery, authorities said, though no robbery charges have been filed.
The criminal cases are pending. With a number of the coins suspected to be legitimate, and counterfeit coins as accurate replicas, an examination of all the coins by a certified expert is pending and will determine the exact value of the legitimate coins, prosecutor's office spokesman Capt. Jeffrey Paul said.
The lawsuit seeks the forfeiture of all of the coins, as well as court costs and attorney fees.
