Anybody Recall This Counterfeit Rookie-Card Case ?

Seems the likely penalty simply encourages more fraud.

A Monroe County man admitted Friday to making as much as $10,000
selling fake rookie trading cards on online auction site eBay, a scam
that could land him in prison for up to 20 years.
Jamie Lee Nucero, 25, of Marshalls Creek, pleaded guilty to mail fraud
after he was charged in federal court last month. He remains free
while awaiting sentencing, scheduled for mid-November.
In U.S. District Judge Thomas I. Vanaskie’s courtroom Friday,
Assistant U.S. Attorney Wayne P. Samuelson said Mr. Nucero first came
to the attention of investigators in December, after a person in
California and another in Virginia reported they had been swindled.
In both cases, the victims were the winning bidders on what were
listed as “rookie trading cards” for star National Hockey League
players Mario Lemieux and Patrick Roy. After sending their money to
Mr. Nucero’s former State College address, they received the
counterfeit cards.
State College police obtained a search warrant for the address, where
Mr. Nucero was living at the time. Officers found receipt slips from
eBay auctions and about 11,000 counterfeit trading cards for a variety
of sports, according to Mr. Samuelson.
Under the plea agreement, prosecutors will recommend a probation
sentence, though Judge Vanaskie does not have to follow that
recommendation.
Mail fraud carries a maximum of 20 years in prison and fines of up to
$250,000. Judge Vanaskie also may order Mr. Nucero to pay restitution,
though Mr. Samuelson said the total amount of money involved has yet
to be calculated.
Mr. Nucero makes his living selling sports cards on eBay, defense
attorney Joseph D’Andrea told Judge Vanaskie on Friday.
The judge decided that Mr. Nucero can continue to sell trading cards
under the supervision of federal probation officers.
“This is his only livelihood,” Mr. D’Andrea said. “If he does it
legitimately, I don’t see how it’s a problem.”

Fake Card Sales Stopped But Where'd They Come From?
28 August 2008
U.S. officials prosecuted one seller of counterfeit trading cards, but stopping the flow is more challenging.
A Pennsylvania dealer who admitted selling counterfeit sports cards could be facing no worse than probation, but the source of those fakes isn't likely to see jail at all.
Jamie Nucero of Marshals Creek, PA, was arrested last spring after federal investigators received complaints from two collectors who say they purchased bogus rookie cards of Mario LeMieux and Patrick Roy on eBay. A search of Nucero's home led them to a stash of about 11,000 more cards that were not manufactured by a licensed sports card company. He pleaded guilty in U.S. District Court Tuesday and will be sentenced in mid-November.
On Wednesday, U.S. attorney Wayne Samuelson told Sports Collectors Daily that the government recommended no jail time for Nucero because the dollar value of the cards involved wasn't high and Nucero was cooperative with investigators.
It wasn't strictly a counterfeit selling operation, according to Samuelson. "He was selling legitimate cards as well. The counterfeit cards were sprinkled in with his other sales. They were not being advertised as reprints."
Nucero is not being held and a judge in the case is permitting him to continue his sports card business. Samuelson said the counterfeit cards will be destroyed.
While investigators attempt to find out if any other collectors may have purchased counterfeit cards from Nucero, the source of the material may be more difficult to prosecute.
The cards originated in Canada and while U.S. investigators have contacted authorities there, Samuelson said Canadian law apparently makes it difficult to arrest first-time offenders regarding copyright issues. Warnings come before arrests.
"They first have to tell the person it isn't legal and to stop doing it. Then if they do it again, they can be prosecuted. They indicated to us there was very little they could do in this case."

This might not be the same Nucero..............
GMA has been happy to grade one of the most stunning baseball card sets in the industry. After 9 years of hard work peacing together this amazing set Jay Nucero is finally complete! The set we are speaking of is probably one of the most sought after sets of the 1980’s which features rookie cards of Roger Clemens, Mark Mcgwire, Kirby Puckett, and stunning cards of over 15 Hall of Famers. Not only is this set full of stars, it is also a TIFFANY set. If you are not familiar with the 1985 Topps Tiffany Set it is one of the rarest sets that Topps has ever had on its production run. With approximately only 1000 sets ever distributed to the market, this set is extremely rare. Now you might ask 1000 sets is definitely rare but I have seen some of these sets. The question is, have you ever seen a fully completed set professionally graded all Gem MT 10! Thats right, the whole set is graded Gem MT 10. Jay Nucero has been purchasing sets and sifting through broken sets at shows for the past 9 years to finally piece together this gem of a set. Jay believes that he has looked through over 100 sets to get this set completed.
The value of this set is almost impossible to calculate. If you calculate the time spent, money spent on sets, and grading fees we would be looking at a large chunk of change. Considering it is a one of a kind item it really comes down to what will someone pay for this rare oddity. If someone is interested in purchasing the set please contact GMA and we will he happy to foward your information to Jay himself. We would like to thank Jay for using GMA Grading as his sports card grading choice and hope to be a part of his future Rare set making projects.
Cards look like a bunch of OC/MC garbage, to me.

Own Your Own Sports Card Grading Business
January 12, 2008
GMA Grading is the only company to offer the Grade Your Own Service to the public. This offer has come with much scrutiny but hopefully this will be explained in detail in the post. We offer up two options for the person who wants to own their own sports grading card business. This does not mean that if you want to submit 100 cards and give them all 10’s that you will be aloud to do so. What it does mean is that if you believe you have the knowledge and have the experience in grading this is a great money making opportunity for you. We will show you how and will walk you through each step of the process. We will help you with label selection, corporate branding, and the marketing of your new business. Depending on which of the two options that we have to offer you could be up and running in as little as three days. Sounds expensive? No, not at all. The only money outlay you will have is the original product cost and processing. So that translated means you will only pay for the inventory that you purchase. No unnecessary fees or hidden costs. Please look at the two options we have to offer and feel free to email us if you have any questions or concerns.
Option #1 :
This has been the option of choice for many of our current customers that have decided to open their own business. They have chosen this option for one of a couple of reasons. Here is how it works.
1. You grade the cards and then send them to us to do the rest.
2. You play a flat fee.
3. We receive the cards and than add your company logo, create the proper label with player name, manufacturer, and card details. Once this process is finished the cards are than encapsulated.
4. After the encapsulation process where the holders are welded shut. The cards are shipped back to you. This process takes 5 business days.
The benefits of this option are simple.
1. No initial money outlay accept first order fee.
2. Cards are shipped back within 5 business day from the day we receive them.
3. Card labels are branded with your company information so you can take submissions from your own customers or have your own cards graded for resale.
4. You are responsible for the grading and we do the rest. This process is extremely simple and we even have in house designers which can help you with the logo.
The fees for this option is $1.50 per card plus the proper shipping charges. Minimum orders of 500 for the first initial order and than 200 minimum after that. If you have any other questions please contact us.
Option #2
Our second option that we offer is you purchase the holders from us and blank labels. You do all the work. Your minimum order is 500 holders per order. This option gives you ultimate control of your own business. Once the holder are purchased they are shipped out the next day and everything else is left up to you.
Note:** for this option you will need to purchase an Ultrasonic welder to seal the holders. A horn that fits our parts and an air compressor for the welder. The outlay can cost anywhere from $10,000 to $25,000 depending on which machine is purchased. We do not sell the machines but if you choose this option we can give you all the details of who does sell these units.
This is the more expensive option but if you would like to do on sight grading this option is available.
Unbelievable.

PCA "grading"

Buys beaters under EBAY ID

Some such cards end up in PCA - or other madeup names - slabs.
This outfit is pumped on the pca site:
seller
//////////////////////////////////////
The probation guy offers to use any slab-name and give any
grade, in exchange for money.
Somebody should contact the PA probation dept - and the
court - to let them know their "rehab" efforts have spawned
another RICO case.
The person that purchased the card and where I shipped it was named Jamie L. Nucero.
But the message they sent me was signed Jay.
Claimed they were going to holder the very low grade card they bought from me in one of thier other holders. "make it a CGS 10" as not to tarnish the PCA name.
I wonder just how many grading companys they have going???
<< <i>this is the guy who is selling the "fantasy/counterfeit" Ripken 1981 Rochester cards that Chris from 'Ripken In The Minors' detailed last week >>

Yup.
////////////////////////////////////
The admissions the guy has made in private communications
are more than enough to get the PA LEOs back on him.
It appears he may have gotten his first set of supplies from GMA.
His new set of scams were all orchestrated while he was
being "supervised" by the probation monkeys.

EBAY really needs to crack down on all the bogus grading gangs.
