SNAD - Scratch on PSA holder? Really?

Just got threatened with a SNAD claim for a scratch on the PSA slab on a card that was just graded on 8/23. Really? How do I fight this claim?

    SNAD Definition

    What is Significantly Not as Described (SNAD)?

    An item is Significantly Not as Described if it is materially different than what the seller described in the item listing. Here are some examples:

    You received a completely different item. Example: You purchased a book and received a DVD or an empty box.

    The condition of the item was misrepresented. Example: The listing said "new" and the item was used.

    The item was advertised as authentic but is not authentic.

    The item is missing major parts or features which were not disclosed in the listing.

    You purchased three items from a seller but only received two.

    The item was damaged during shipment.

    ...................

    What a SNAD is NOT

    An item is not Significantly Not as Described if it is materially similar to the seller’s item listing description. Here are some examples:

    The defect in the item was correctly described by the seller.

    The item was properly described but you didn't want it after you received it.

    The item was properly described but did not meet your expectations.

    The item has minor scratches and was listed as used condition.

    As we all know:

    A successful SNAD-defense is labor intensive.

    It often requires repeated "appeals."

    The listed/sold item was a previously-owned/used PSA-graded CARD.

    A minor scratch on the slab does not constitute a SNAD item, as the
    same is contemplated and defined by the PayPal User Agreement.

    The sold item was delivered exactly as described in the listing. Thus, the
    item cannot meet the definition of SNAD, either factually or legally.

    +1 for a road trip.
    When I was a GM in the racing industry I remember hearing my sales manager telling a customer on the phone he would gladly meet him half way there.

    I said to him after the call, "What??" He said to me that he had an azzwxxxxxxx customer on the phone from Texas threatening to kick his azz because he was mad..then my manager said to him that he would gladly meet him half way there if he was man enough...The customer hung up and we never heard back from him again. image

    The dork could easily just get a scratch remover at Wal-Mart. I forget the name of the product, but it's been discussed here before.

    I don't know what you can do with a scratch free PSA card that you can't do with one that has a scratch. Then again, I don't know what guys like that do with them anyway? I imagine it probably involves a paper towel, though.

    Chances are good that he just wants an offer of a partial refund. If the card sold for a normal price I would take it back for a refund less shipping, to try to avoid the negative, but if it sold for a lot then maybe you just risk the neg.

    To win your SNAD argument maybe argue that the card inside and the red label showing the grade are the value, and the holder is just the wrapper. Point out that a new holder costs $5 and that the holder isn't a large part of the value. I used that argument once with ebay and it worked.

    Even though I vote for the Road Trip, the first thing you need to do is give us his Info so we can block him. Secondly, and I don't guarantee this will work (But is has for me Twice recently) tell him no problem, return the item, and you will be providing his E-bay ID on several Boards you belong to so that he can be blocked as a Buyer. Twice I told an As$W!pe recently who had threatened me with a Neg over nothing that I was going to do this, one didn't leave the Neg and the second E-mailed me back begging and aplogizing to please not (Must have pulled the crap before and gotten Blocked).

    Simply tell the buyer to return the card on his dime, and that you will refund only the purchase price.

    That is what you are obligated to do anyway. Suck it up and take the neg as well. People will read right thru it.


    Block the buyer.

    If he file a paypal claim, they will instruct him to return the card to you at his expense for a full refund of his purchase price including shipping, so I'd just sit back and see if he follows through.

    I agree about the dork part.

    All he would need is some car wax he already has in garage or closet.

    Tell him to wax on and wax off William.

  • It would be best to try apologizing and ask him to please return it for an immediate refund. He might just drop it.
  • I had a buyer just do this to me. I told him to return card (30.00 card) and get a refund, he then emailed me and said it wasn't worth the trouble, I guess he thought I would give a partial refund or something. (Not).

    Of course if this is a high dollar card it might be a scam. crack the slab put another lower grade card in and return to you. hope it works out for you.

    I vote for the road trip if it doesn't work out for you.

    He likely scratched the slab while he was carelessly opening the package - I agree with just refund his money, and be done with him.

    Unless I quit the hobby, you will never see a high dollar card listed in my store.

    Was only a $30 card and just came back from PSA 2 days before I listed it. I made the PSA submission public and sent him the link so he could see that it more than likely came back from PSA with a minor scratch. Offered a full refund if he returned the card. No response yet.
