Seems kind of harsh, but whatever.

He would have been better off getting drunk, killing someone with his car, and paying the family off. It was the "unregistered gun" part that really put the nail in the coffin.
Looking for rare Randy Moss rookies and autos, as well as '97 PMG Red Football cards for my set.

    Gotta love our Justice system.

Shoot yourself and go to jail for 2 years

Kill dogs and go to jail for 2 years

Kill a man while driving under the influence ... go to jail for 30 days.

No, I don't want to debate the issue ... yes I am an attorney, but I know nothing about criminal law.

    Just giving my opinion.
    STAY HEALTHY!

Liquidating my collection for the 3rd and final time. Time for others to enjoy what I have enjoyed over the last several decades. Money could be put to better use.

Wish we had a Sports Talk forum, then your thread would be "OT". image
I collect Vintage Cards, Commemorative Sets, and way too many vintage and modern player collections in Baseball (180 players), Football (175 players), and Basketball (87 players). Also have a Dallas Cowboy team collection.

A little extreme in my mind, too...
  • Not me to decide whether its too harsh or not but...

New York has the toughest gun laws in the country and Why the hell did
he bring an unregistered gun to a nightclub anyway?

Well its OT because its not card related but i do suppose that now his cards will be in the common pile if
    they weren't already

He should have hired Stallworth's lawyer.
Antonio Pierce is very lucky he did not get sent away for just as long.
  • burke23burke23 Posts: 1,475 ✭✭✭
Not that I agree with it, but wasn't there a bit of leniency for Stallworth since he hit the guy in the street, and it wasn't at a cross-walk? So the thought is even sober it could have happened? Not like Leonard Little in the early '00s.

I thought the gun was licensed and registered, just not in New York.

    Perhaps I'm wrong.

In any event, I carry a handgun in my truck and have a license to do so in my state. I don't remember to take it out when I cross the state line, perhaps I'll end up sharing a cell with Plax?

I'll agree with the penalty seems unjust. Going to jail for 2 years for having a gun with no intention of using it on anyone.
  • He should have let it go to trial. I'm sure a few Gint fans could have hung the jury.

It was but it had expired.

You could drive 90 mph, flip your car over 7 times, kill one passenger and severely injure another
and all you would get is a 500.00 fine, and lose your license for 90 days too.

Then when the victims family asks the DA why such an easy punishment they are told "well it was a simple accident'

IMO getting 2 years for what he did is harsh. He claimed he was carrying the gun because a few days earlier he or someone he knew was robbed
    at gunpoint.

A better punishment would have had him do 1000 hrs of community service. Maybe speaking in schools or something.

They threw the book at him cuz he is famous.

    Steve

    Good for you.

Seems some pretty simple points to me.

    1) Realize which city you're carrying an unregistered gun into a crowded nightclub.

    2) Realize the consequences should the above be discovered by the law.

    3) The law is the law, and it shouldn't matter if you're famous or not, or if you're an idiot and the gun accidentally goes off and shoots yourself. Obviously, the potential for danger was astronomical and he's VERY lucky it was a non-lethal wound and that no one else was shot or killed.

    4) Plaxico is a complete idiot who feels that rules are for others to follow. He, like anyone else in his situation, deserves fully what the law hands him.

    5) He'll likely be out earlier than 24 or 20 months.

Hopefully he'll mature and get some sense. It's utterly ridiculous that some people just either never consider the consequences of their choices or actions, or that IF they do, they do not care. The old "it'll never happen" attitude.

Just watched the ESPN video where his lawyer has his press conference. Wow . . . how can that guy not keep from busting up? "This was not an intentional criminal act. In my judgment, a two-year prison sentence is a very severe punishment." -- Benjamin Brafman, Plaxico Burress' attorney

Plaxico CHOSE to break the law by taking a gun into the nightclub!

Steve, you know that if it happened to either you or me, we'd be facing 2 years. Why should it be any different for Plaxico? If anything, it sets a better example for those who should be role models.
  • 'Sure, I'm breaking the law, but it's okay because *I* don't have to follow laws'

    hoo-boy

    Zixx

If it happened to you or me (first offense) I doubt very much we would get 2 years. WE may face 2 years or whatever

but I highly doubt we would get it.

This was his first brush with the law right?

    Steve
    Good for you.
  • ZixxZixx Posts: 228 ✭✭
Maybe his first brush other than fines and tickets, I really do not know.

But I think what hurt him (no pun intended) most wasn't that he had the gun, but that it discharged inside a crowded nightclub. The potential for greater danger was pretty high. Secondly, if this had happened in Dallas or L.A. or Miami, I think there could have been a different result.

I still think, if you or me, we'd be facing 2 years. Why chance it in the first place?

"...A better punishment would have had him do 1000 hrs of community service. Maybe speaking in schools or something...."

    ////////////////////////

There are lots of reports that he was offered MUCH better deals, but
rejected them prior to the indictment.

He wanted NO jail time, and LARGE community-service hours.

His legal team reportedly urged him to take 90-days and 3,000+ hours
of CS. He said he thought he could win in front of a trial jury. After a
Grand Jury changed his mind, he took the 2-year deal.

A bad verdict outcome and a crazy/ambitious judge could have brought
    him more than 10-years.

Celebs that fear for their safety are best off hiring a licensed posse to
protect them. Or, they can simply stay out of extra risky circumstances.

The cops loved this guy for as long as they could, but his bad attitude
    and inconsistent statements alienated them.

    ........

Such folks need to learn some medical skills, and avoid public hospitals.
(Instead of reporting the accident to the cops, the hospital staff tipped
the media. The cops learned of the injury via TV.)

If he had patched himself up, thrown away ALL of the evidence, and
kept his mouth shut he would have likely been home free.

    ..........

FL has a 6-month statutory extension on permits. He could have gotten
another extension by court order, but such permits have no validity in NYC.

    ...........

The guy's record of doing "minor bad stuff" is a bit substantial.

He's lucky that he shot himself and nobody else.

He will be back in the NFL before we know it.

Again, most people can get up, go to work and NOT break the law.

An abnormally larger percentage of NFL, NBA, MLB and NHL players break the law compared to normal citizens. Sometimes the only difference between a law abider and a law breaker is the money to do the latter.

He should have taken a chapter from Pacman's playbook and made it rain in the courtroom yo.
  • Should have come to Louisiana and shot himself. We would have just laughed at him and gave him a fine as long as he signed autos at a local used car lot.

I'd let him sign autos at my car lot as long as he bought a car.

Maybe its time the courts made an example out of one of these thugs. Maybe he and OJ can be on the same "team"

You got me. I love them.....while they SUCK!!!
  • I though the penalty was harsh but I think NYC had a very public case and they wanted to make a statement. From now on who would be crazy enough to carry an unregistered gun around NYC when you can count on 2 years in jail. Might be called effective gun control for the city.
