What to do about a low dollar auction win...

I won an Ebay auction 18 days ago. In all I have won 11 auctions since then anywhere from the .99 to $70 range. I've also received all but 1 of the items that I've won since then (that item having been won within the last week). I've sent 2 emails now to the ebayer and gotten no responses. Based on feedback I notice that the seller has shipped two items that were won after my auction and those people received their items over a week ago.

So I got a few questions for you guys:
What's the longest you've had to wait to receive an item that you paid instantly after winning the auction?
Am I wrong to want some sort of reply to let me know that he's shipped the item (he appears to be a low volume seller with only 24 feedback)?
At what point would you request a refund, or would you?
Since you have 45 days to file a claim, when should you file a claim and would you bother for a $5.50 auction?

Would you ignore the whole mess of potential negative feedback on a $5.50 auction?

    I basically wait 3 weeks before sending a polite email. At that point, if I get no response (which is generally the case the few times I've had to do this), I file a claim with PayPal around day 30. If I hear from the seller, we negotiate how to proceed. If I believe the seller is telling me the truth about the circumstances of the transaction, I likely let it slide and chalk to funds up as a loss. If I think the seller is full of it and wont have open dialogue, I file claim with PayPal.

    You realize the seller can't neg you, right? I'd maybe send one more email asking for tracking info, wait another week or so, get my $ back from paypal and leave appropriate feedback stating lack of communication and item not rec'd...

    Honestly I didn't know that, I got off ebay for a couple of years, because I was unhappy with their system (I got scammed out of an item that I was selling + Chargeback + Neg = no ebay/paypal for awhile, I heard it was a tad better so I'm giving it a second chance), just got started back on both buying and selling.

    I'm sorry, I intended the post to read that the only items I had not received from my recent auctions were the item in question in my post and one that I had not received because I purchased it within the last week.

    I usually send a polite email after 2 weeks of payment being sent and if no communication, I email again at 3 weeks and if no response comes my way by 4 weeks I initiate a claim with paypal.
