Is this a partial punch 1940 error Jefferson?

I picked this up a while ago but just started to look closer at it now. Could this be a partial punch error?

The reason I think it might be is on the obverse specifically - I suppose it could be a lamination but the arc of the area seems to be too 'coin' shaped to me.

The reverse show some signs of this as well but it is not nearly as pronounced.

so what do you think?

No, it's not. There would be distinctive involvement at the rim where the incomplete punch intersected the struck rim. It would have metal flow similar to that seen on clips. This one doesn't, so it's not.
