Non-paying bidders can leave negative feedback?

I just received a negative feedback from a guy who I currently have 6 open NPB cases against. This outstanding ebayer is the guy that created a user ID last Sunday just to outbid others on my auctions with no intention of paying and quickly NARU'd the ID after the auctions ended.
Before the neg came from him, he would not respond to emails and his phone number is 'disconnected'. I emailed ebay about this and did not receive a response.
Immediately after receiving the neg, I filed a feedback removal request with ebay (which they answered within an hour). They stated that this transaction does not qualify for removal. WTF? Seriously? This guy has not paid for the item (ended on 5/30), has an open NPB case for it, yet he is somehow justified in messing with my feedback?
I feel as though I have taken every necessary step in this but maybe I'm not considering something. Any other advice? Do sellers have any protection against retaliatory negative feedback?

It has always been so; and rightfully so, in my
view.
If a NPB fails to respond to a seller's NPB filing,
the NPB's FB will be removed by EBAY upon the
request of the seller.
If a NPB, in response to an NPB filing, fails to cite
a problem with a seller's "product or service," the
the NPB's FB will be removed by EBAY upon the
request of the seller.

"I was told by a third party that the buyer sells counterfeit cards,
and I no longer want to deal with him."
"The buyer was extremely mean/rude to me when I asked for
payment instructions and I no longer want to deal with him."
Both such NPB responses by professional SCUM masquerading
as buyers on EBAY preserve their right to destroy an honest
sellers business. EBAY will not remove such FB.

This was the message ebay sent last night:
"With regard to your second concern, we can remove Feedback if it's
abusive or meets any of our other conditions for removal. Unfortunately,
this one doesn't.
Although this is the case, you can ask the buyer to revise that
feedback.
However, before submitting a Feedback revision request you need to:
- Resolve any problem that took place between you and buyer during the
transaction Huh? Where do I even begin? How do you resolve something like this? I can't even contact the guy.
- Contact the buyer to tell him or her that you're requesting a Feedback
revision and explain your reason" Sure, since that's worked so well up to this point!
So a guy doesn't pay for his winnings and won't respond to emails and has a fake phone number and I file the appropriate NPB alerts to recoup my fees and he can create a new ID to win ONLY my items out of spite, leave me negative feedback and because it doesn't fall under these guidelines, this is all somehow okay?
And what is ebay going to do about this guy creating more IDs to do this to me again in the future?
