E-Bay Wax Pack Debacle Continues: What Clowns!!!

Good day,
Many of you were aware of what happened last weekend with my worthless Crap Non Sport .99 cent Wax packs. Long story short they dinged me with so many Policy Violations to the point where I was an inch from being banned.
The following is the continuing e-mails back and forth between myself and the A$$clowns at E-bay. As well It took 8 phone calls as well to their Power Seller line. You have to read from the bottom up to understand.
And the Bottom line is they haven't clarified anything so I still will not be selling Wax Packs and am warning everybody else!!!!

Dear Neil,
Thank you for writing eBay in regard to your listings that were
recently removed.
Unfortunately, the policy pages haven't been updated to reflect this
policy change as of yet however we will have something posted shortly.
To summarize, this policy was created in an effort to pursue sellers
who are packing wax pack wrappers with worthless trading cards (or
'stacking'), sealing them and listing them on eBay as
'unopened/unsearched'.
Obviously, the prospect of finding a rare or valuable trading card
dramatically increases the value of these packs.
Furthermore, after reviewing your listing, it appears that your wax
packs would not be in violation of this policy. As a result of this
review, I have corrected your account to show that this action has been
overturned and I have also reinstated your listings. They should now
appear as an unsold item in My eBay.
You may relist the your items from My eBay by clicking the "Relist"
link next to the item in the Unsold Items view. You can also relist
these items by clicking the "Relist" link on the item page for the
listing. Also, please be aware that it may take up to 24 hours for your
Seller Dashboard to update.
If there were any bidders on your listings, we have emailed each of
them to let them know that the listing was ended in error and that they
are welcome to replace their bids if you decide to relist it.
Finally, on behalf of eBay, I sincerely apologize for any inconvenience
this action may have caused.
It was my pleasure to assist you and thank you for your understanding
in this matter.
Sincerely,
Gillespie

Good Day,
No your answer did not clarify anything. Are you ignoring me, my issue
was not the content of the listing being questionable or not questionable. I
DON'T CARE ABOUT THE LISTING Being Removed, What I care about are the
rules being changed half way through the game and me being punished for it. I
sold these items for years, you sent me an E-Mail on Sunday saying that the
Policy had been Changed!!! Fine, Change your Policy, I don't care,
change it, that is your prerogative. Then you damaged my Compliancy rating
because of this after action punishment. That is not right nor a proper way to
do business!!!
Please restore my compliance rating up one notch to where it was before
this action.
Thanks You

Dear Neil,
Thank you for writing eBay in regard to your recently removed listings.
Please understand that eBay isn't in a position to judge the
authenticity of items that sellers list on the site. Your listing was
removed because it contained some questionable content.
-- Important --
Because repeated violations of eBay policy may lead to listing
cancellation, limits on account privileges, and suspension, I recommend
that you review the eBay Replica, Counterfeit Items and Unauthorized

Message: Good day,
Thank you for answering my E-Mail. Apperently you did not understand my
concern. I am not arguing with nor asking why my listings this latest go
around were removed. Your E-Mail that was sent to me on their removal
was clear: A Change in Policy this weekend disallowed Unopened Wax
Packs. This E-mail (Mine) is not about that action. This E-Mail is about
retroactive Policy violations. I have listed those items and sold them
for years on E-Bay. Your message clearly stated that the policy was
Changed this weekend and they were removed. So Be It! What is not right
is the fact that my listings were done before this ban and your change
in policy should not cause my compliance to be downgraded after the
fact. If I would have been notified of THIS CHANGE in Policy before
removal I would have removed them myself. PLease restore adverse action
to my compliance due to this action.

Dear Neil,
Thank you for writing eBay in regard to your recently removed listings.
I understand your concern about the listing that we removed.
Unfortunately, I can't tell you exactly why it was removed for security
reasons. But I took another look at it, and I see that we removed it
because it had certain things in common with listings that aren't
allowed on eBay. Because of this, we won't be able to restore the
listing.
Please understand that it's against eBay policy to sell counterfeit or
unauthorized items. It's also illegal. We remove listings that violate
our policies.

Dear thedutymon(cami@sopris.net),
You recently listed the following listing:
200346550622 - 1979 Topps Black Hole Wax Pack Lot 4 Unopened
200346551251 - 1979 Topps Black Hole Wax Pack Lot 4 Unopened
200346551482 - 1987 Harry & the Hendersons Wax Pack Lot 2 Unopened
200346552055 - 1988 Topps Dinosaur Attack Card Wax Pack Lot 4 Unopen
200347266355 - 1981 Topps Cute'N Cuddly Animal Poster Wax Pack Unopen
350206877697 - 1980 Topps Here's Bo Card Wax Pack Lot 4 Unopen
350206877958 - 1983 Jaws 3-D Card Wax Pack Lot 4 Unopened
350206878417 - 1970 Donruss Skateboard Sticker Wax Pack Lot 2 Unopen

350206879633 - 1987 Topps 21 Jump Street Wax Pack Lot 4 Unopened
The listing was removed because it violated eBay policy.
POLICY CHANGE: Due to recent fraud concerns, unopened/ungraded wax
packs will no longer allowed on eBay
eBay doesn't allow sellers to list items using someone else's trademark
-- the unique name, word, phrase, logo, or symbol that identifies a
product or service -- unless the item being sold was made or authorized
by the trademark's owner.
So while we hate to cancel listings -- it's disappointing for everyone
--- if an item appears to infringe a trademark, we'll remove it.
Before we decide to remove a listing, besides reviewing the listing
itself, we may also look at:
-- Buyer feedback and overall account standing
-- Whether you have any unresolved disputes
-- Your selling history and current selling activity
-- Whether you have previous feedback questioning the authenticity of
items
Thank you for your understanding.
Sincerely,
eBay Trust & Safety team

'stacking'), sealing them and listing them on eBay as 'unopened/unsearched'. "
So it would be okay to list them as opened/searched.
Besides all the hassle they put me through (And we are talking hours here), I think you are missing my main point!
WHAT POLICY????
They can't even make up their own minds, while my stuff was pulled there were hundreds of other E-bay Sellers selling the same crap Exacty as I was Selling, and I did a bunch of searching and their were dozens of the Crooks that this was supposesidly targeted for Selling Bogus stuff, openly Selling on E-bay, 50's, 60's, 70's Unopened UnGraded Basketball, Football, Baseball Packs, hundreds of listings, I even reported one Crook, Creekside's Scammer auctions on Sunday after mine were de-listed and they never did anything.....Period!!!!
Policy My A$$$
I just spoke to them again and asked specific questions about Vintage Sports, Non Sports, Ungraded, Unopened, numerous questions, even took it to a Supervisor. No definition of the policy at all, they will take it on a case by case basis...This is their New Policy!!! Same old BS!!!!
Give me a Break!!! And they can take their apology and put it where the sun don't shine!!!!
Anybody who actually thoght E-bay was going to actually do something positive about the Crooks on their site had better grow up!!!
Neil
I'm not missing the point. If you have been using eBay for any given amount of time then it's a known that this is how they run things.
Ask a question 15 times and you will get 15 different responses. At least you were finally able to get a response that they made a mistake and that they are fixing it.
And yes I know all about the hassle of things. We are fighting something here (not going to get into details as it would take to long) going on two years and still trying to find someone that gives a dang enough to make the matter right. It sucks but it seems that for some people it's part of life to have to fight every step of the way.
