Should I file a SNAD over a $28 coin?image

EDITED: After contacting the Seller via ebay e-mail and requesting a refund due to the scratch, the Seller agreed to accept the return of the coin. He posted the refund to my Paypal account yesterday. Some ebayers are honorable and olddk is one of them!

During our exchange he revealed that he will turn 80 next month. Says he uses a a razor cutter alot and may have caused it when shipping. This Seller could set an example for alot of other ebayers out there, IMHO.

    Always contact the seller first.

$28 or not, I'd be pissed.

In general I'd do this: if the seller has a return policy, just return it. But this listing says no returns are accepted.

If the seller has "no returns allowed," tell them you want to return it anyway because the coin received is nothing like the image used to sell it. If they agree to accept a return, then return it -- and if not, then consider the SNAD option. But give the seller a chance first, even if an SNAD is tempting because of the blatant misrepresentation by Photoshopping the scratch out of the image in the listing.

This is an example of why I don't bid on items with no returns allowed. It's also a good example of when it's actually a good thing that the seller can't leave a negative for the buyer.

I suggest you check the obverse first to see if it has the clash with the Indian cent obverse (as seen in Cherrypickers). Even with the scratch, if it has the clash it's worth a lot more than $28. Then you could keep the coin and get the "last laugh".

I realize this is a long shot, but that scratch looks pretty fresh - any chance that was caused by a staple or some other mishap during packing, unpacking or shipping? If it really was Photoshopped out of the auction picture, then my complimetns to whomever did the work because I can't see any trace of manipulation in the original image.

If not, then I agree with the poster above about contacting the seller first regardless of his stated policy.

    Sean,

It is a fresh scratch. I don't think the Seller photoshopped the image. Below is the e-mail that I sent to the Seller today:

    << <i>Hi Donald,

I received the 1870 Shield Nickel yesterday. Thanks for the prompt shipping!

However, on the reverse of the coin there is a very deep scratch from rim-to-rim starting above the letter D, bisecting the letter E and running between the stars and beneath UNITED to the left of the 5 all the way to the other rim, passing to the left of the dot on the left side of CENTS.

I have retained the original packaging material and it has no evidence of being disturbed in anyway through handling by the USPS. Therefore I epxect the damage occurred some time shortly before it was packaged and shipped as the scrath is very fresh in appearance.

This damage was not mentioned in the auction description nor was it included in the auction picture. As a result, I am requesting return privileges with a full refund of the auction selling price.

Please advise how you would like to proceed.

    Regards,

    Kirk >>

I'm conflicted, you bought a raw coin with so-so images on ebay, from a seller that says no returns.

    What were you expecting?

The scratch is pretty fresh. Images are typical of the distortion caused by ebay's high compression ratios. I think the coin got scratched after the ebay image was taken.

As for my expectations: 1. The Seller has a 100% FB score. 2. The coin depicted in the ebay photo, sans scratch. So I was expecting an "excellent condition 1870" as described and depicted in the image w/o a scratch. Except for the scratch I got what I believe is a nice XF coin that apparently was scratched accidentally during packaging. It is the same coin depicted by the Seller, but with the scratch.
