Problem with American Memorabilia
American Memorabilia has owed me 3-4,000 $ since last October and still hasnt paid despite several phone calls and emails. Are they in financial touble? Has anyone else had this problem? What can I do ?

After reading their website, I cannot imagine why anybody
would consign anything to this outfit.
I am NOT saying that anybody "deserves" to be stolen from,
but there is such a thing as simple due diligence.
......
I would call the FBI office in their city and tell the FEDs that
a scamarama is using the FBI's name to entice new victims.
I would then IMMEDIATELY file a lawsuit in Small Claims to
seek a money judgement.
I would then call the AG's office and tell my story.
I would then call the Clark County Prosecutor's office and tell my story.

Nondischargeable Debts
Bankruptcy will not discharge all debts. Some debts will survive the bankruptcy process and are as valid and collectable as they were prior to the bankruptcy.
Some of these debts are:
Fines or restitution (to the court or victim) imposed in a criminal-type proceeding (11 U.S.C. 523 (a)(7) and 18 U.S.C. 3613).
Fees imposed by a court for the filing of a case, motion, complaint or appeal or for other costs and expenses assessed with such filing (11 U.S.C. 523 (a)(17)).
To get any of these debts discharged, you must file a "Complaint to Determine Dischargeability" of a Debt with the bankruptcy court and then show, in court, that your debt isn't covered by the general rules which say that these debts are not dischargeable. This is an adversary proceeding.
In addition, there are categories of debts which will be discharged unless the creditor objects to dischargeablity. These include:
Debts incurred on the basis of fraudulent acts (11 U.S.C. 523 (a)(2)).
Debts from willful and malicious injury to another or another's property (11 U.S.C. 523 (a)(6)) - an intentional tort (conversion, assault, battery, etc. . .).
Debts from embezzlement, larceny or breach of trust (fiduciary duty)(11 U.S.C. 523(a)(4)).

The best play is for the victims to get LE involved NOW; before any
contemplated BK filing.
In the event a BK is filed and no LE action has been concluded, the
creditors will have an opportunity to contest the discharge. They
can do so in person, by written motion, or by retaining counsel to
appear on their behalf.
The folks who have the best chance of getting relief post BK-filing
will be the ones who have Judgements in hand prior to that filing.
