Ebay seller fraud question

I have a question and was looking for a little help, advice or guideance.

I purchased 3 cards from a seller on March 24. I combined wins for a few days and paid on March 30 through Paypal. I received an email through the ebay system on April 3 telling me that he would not be shipping my 2 lower priced cards and he was sending a partial refund through paypal. He claims that he misplaced the cards. The 2 missing cards were both PSA 10 for $4.95 each.

I check Ebay today and a different seller in the same city has my 2 cards in his store at $29.99 and $12.99 each with a make offer.

Is it worth it to report him to Ebay through the "Seller refuses to complete the transaction" link? Do I just leave negative and go on with my life? I was tempted to buy the cards again and leave Negatives on both sellers. They are both 100% feedback with one at 6700 and the other at 1800.

I wanted the cards and I think this really stinks. We have all had to suck it up and sell for a price that did not reach what we wanted for our item. That was his fault for starting his auctions at $4.95.

Any help would be great.

    Okay, by saying the same cards they have the same serial number? If so report that putz. Good luck!

    I'd wait until I got the one card, then I'd blast the guy with negatives and inform ebay too.

    I'm a very vindictive person.

    You analyzed it exactly right.

    Just in case you didn't know, ebay changed the rules about a year ago - sellers can't leave negs for buyers, so no need to worry about a retaliatory neg. You could send him a "nice" e-mail with what action you will take if he "doesn't make right" on the transaction and give him one more chance - it's your call. If he doesn't make it right, then yes, definitely neg the weasel bastige.

    I remain clueless as to why experienced sellers continue
    to list stuff too cheap and then wonder why their items
    go for zip.

    Can't force sellers to sell.

    Can't force buyers to pay.

    Such is EBAY.

  • I would guess it is a friends account or something, 6700 positives and 1800 positives is a lot to have for a second account. I am not sure what is going on, but it looks very obvious to me. I have 3 feedbacks to leave this guy. If I leave them a week apart, will they count as a 3 negatives or will it still just be 1 negative? I guess that I could do my best to explain what happened and finish the feedback in a follow up.

    If he would have just told me that he was not going to sell to me at that price, I could have accepted that a lot easier that this stupid lie. At least wait until the first auctions disappear from the Ebay search.

    LOTS of sellers have several high FB accounts.


    Your FB will only count as ONE NEG on his 12-month percentage.
    The scoring is based on the transcation date; not on the FB date.

  • Thanks for the info Storm, I was not sure how that worked. Does it look like I am corrct in my investigation? I want to make sure before I send a nasty e-mail and leave negative feedback.

    I guess so.

    There is no real element of "fraud" in the seller's bad conduct.
    He is simply acting unfairly and in violation of EBAY's TOS.

    Unless you have a specific remedy that you want to demand
    from the seller, emailing him is just a waste of your time and
    mental energy.

    I think I would just NEG him and move on.

    Leave neg on one saying he refused to sell at winning price. Neg the second saying, "claimed cards were lost, but relisted under other ID." That little saga would sure keep me from buying from him.

  • I see the new seller has ended both auctions due to item no longer available for sale! what a joke, thanks for the heads up on these two sellers.
  • As a new eBay seller, it's tough out there to make money at the right time. I've thrown a few BIN at $20 below what the final bid was on a previous item(it had multiple bidders). About 5 people sent me Best Offers at half the BIN. Of course I sent counteroffers and thanked everyone for offering. He shouldn't have started it at $4.99 if he didn't want to sell it at that price. Poor judgement but I wouldn't waste my time and effort trying to "get him" for doing that. Just send an email and let him know you figured it out and he lost a potential customer and possibly more after this post.
  • Just a little follow up on my story.

    I e-mailed him a message and told him that I would be leaving feedback to explain to buyers what happened to me. About 10 minutes later, the 2 current auctions were ended. I never hard back from him. I just laughed it off trying to picture him sitting there squirming, know he had been caught.

    Thursday morning, my postman delivered the 2 cards in question to me with a note inside from the second seller saying he was sorry for the mix up. The original seller refunded the price of the cards and the shipping when this all happened. I don't feel the need to paypal this guy for the cards. I think this was his choice to send.

    Do I leave positive for the cards? I don't think so.

    Lots of dealers sell big piles of crap to other dealers. Maybe your two cards were in the big pile of crap he sold to the other dealer and didn't realize your two cards were in the deal. The auctions ended and he couldn't find the cards so he refunded you. When you told the seller what you discovered he contacted the other dealer about your two cards. He ended the listings and sent them to you. I'd find out who you owe for the cards and send them payment.

    Rose City Sports takes consignments....maybe someone wanted Rose City to sell for them, and it didn't get the price the actual owner wanted. I dunno...
