Current 1979-80 OPC Hockey Ebay Fraud/Scam? w/ user maxxblue1 Please Read...

Hi, I am not sure if this is posted in the correct forum, so if it is not then please forgive me. I was scammed several years ago on a 1979-80 PSA 9 Wayne Gretzky card and I do not want anybody else to be scammed by a current eBay auction.
The item number is 120384042598 and this is the exact same set that I purchased from this seller on 02/07/09. The item number for the set I purchased through this seller is 120372882898
I also purchased a set of Topps 1980 cards from the seller and the cards were in horrible condition just as the OPC's but I decided to keep them because the two cards that I wanted the most (Mike Bossy) were in pretty good shape, otherwise they would have gone back as well.
I paid immediately for these cards after the auction ended and waited anxiously for their arrival. When they did arrive on 02/19/09 I opened the package and the cards were in horrible condition. I mean horrible. There was absolutely no way I could accept them, so I messaged the seller through eBay the same day and told him that the cards had been packaged in their original box and shipped back to him as he had a seven day return policy if not satisfied.
I added signature confirmation and the package arrived at 3:18 PM 02/21/09 and was signed by the seller M. Curry (eBay user ID maxxblue1)
I have emailed the seller three times asking for a refund and in each message the seller says the same thing, "I am in Mexico and unable to send you the money at the moment, please wait until I am back home" and "the current cards listed on eBay are not mine but my son's" and "my feedback is proof I am legit"
I have investigated the seller's buying history and it appears that he buys loose cards from other eBay sellers and then sells them as 'MINT" and "NM-MINT" and "Solid" sets, built with loving care in the 80's and 90's, worth grading at PSA of "not less than an 8" But my question is, if the seller is buying the cards from other sources then how does he know that the cards will even be gradable from PSA? They could be trimmed, sheet cut, or even counterfeits.
Also - this seller appears to be shill bidding, look at the people bidding and you will notice that there is suspicious activity with the user l***a( 1 ) as this user has bid on all of the seller's items, WWII and sports cards, something is fishy there.
I have filed a claim with Paypal and have notified eBay of the suspicious activity on maxxblue1's account. Why eBay has not acted on this yet is strange to me. What also is strange is how a seller with such high feedback could be involved with this kind of poor salesmanship. Maybe he spent my 589.99 and is trying to recoup it through selling the item again. If that is the case then I would hate for somebody else to have to go through what I have, because trust me, the condition of those cards was a joke and whoever buys them from him again will be returning them.

I understand that the 1979 OPC Hockey was a sensitive year, but I don’t share the agreement that most of these cards are in at least PSA 8 condition. I base this on the fact that I have been collecting and building this set in PSA condition for some time now.
My goal was not to profit from this set, but rather to send it into PSA for grading as a collector. I also am a huge collector of Mike Bossy cards, and am currently building his sets in the PSA registry. I was really hoping that all of his 1979 cards (1, 5, 7, 161, and 230) would grade in the at least PSA 8 condition as described.
This is why I will hold onto the 1980 Topps set. I only purchased it for the two Mike Bossy cards (25 and 204) but with the OPC I was buying to keep, and would feel better if I just returned them.
I was unable to go to the post office today, but the cards are packaged and ready to go tomorrow morning. I am sending them the same way they were sent to me, with signature confirmation and should arrive Tuesday or Wednesday. No hard feeling for any of this.

I will send your refund as soon as I get situated...just curious...and respecting your decision in not wanting the set, what was your dissapointment when you checked the condition of the cards?? Thanks....(for my future reference)..

I have been collecting this set for a few years and I just didn’t believe that the majority would grade in PSA 8 condition. I bought the set primarily for grading for my personal collection, including the Mike Bossy cards, which were also a disappointment. Most of the cards had banged corners, were too off centered, or both. I remember one that looked as though it was almost cut in half.
I knew that not every single card would grade an eight, but I was hoping the majority would and I just don’t believe that to be the case with this particular set. I also believe that the price I paid for the set reflects what these cards would be worth if graded in the described PSA 8 condition. If I had inspected this set in person, I would not have paid what I did online.
I see that the cards have been re-listed. I also see that you have responded to my message, which shows me that you must have access to the internet—ie: paypal. I understand that you are busy but I paid immediately after the auction ended and mailed the cards back in a timely manner. Furthermore, I have been keeping in touch with you on a consistent basis throughout this entire transaction. If this were a twenty or thirty dollar transaction, I would not stress the refund, but this is near six-hundred dollars and I would really appreciate seeing that kind of money back into my account. Please respond with a refund in a timely manner, or I have no choice but to file a complaint with ebay and paypal regarding the matter.

Of course, as you can see by my feed back you don't have to worry, It is just a little harder...I am in southern Mexico. That set is not the same set that is on Ebay...That is my son's set...I told my son to hold on to the set I sent you until I get home.I am curious and obviously going to have to reevaluate the cards again based on your critique....Thank You and All The Best!

Max, negative feedback will be left by 12PM Noon in the morning if full refund is not given. This is a gracious heads up as this may have a negative outcome on your current 1979 opc set, that will be ending shortly after.

Wow, what happened...I think you must have misunderstood something I said...I have never had a problem since I started with Ebay...and as in life I am not perfect...but this is a liitle over the top don't you think?...I will get your refund...that is not an issue at all...just my banking and moving money around...it is not as easy from Mexico to operate...believe me...and I do not keep money in my Paypal account....I ask you to be a little understanding, thats all!...and as you can see by my track record I don't "rip people off"...I respect your wanting the refund...let me make it happen. This has gone on for too long. Refund should have been here when cards arrived and were signed for. You have to see things from my point of view. You have almost six hundred dollars of my money. You have relisted the same cards (same pictures in both auctions!) You bought cards from other sellers to fill in the set. You are shillbidding all of your auctions and calling yourself ethical! Scam.
12 pm, that's less than five hours from now. Not only will I leave negative feedback but I will also call ebay and report you. Your 899 to 900 feedback means nothing to me when you are holding near six hundred dollars and practicing in unethical salesmanship.
