Anyone think PBGS/USM falsley advertised...

the UHR with regard to FIFO?; hence damaged customers monetarily? Are there any hungry attorneys on this board?

  • it's not that they lied; they just royally screwed up. unfortunately, stupidity is not a crime nor a legal reason for population control. furthermore, the us mint has much bigger pockets than all of the world's lawyers combined. all we can do is rage against the machine and/or cry like babies.

    How about waiting until after the FS deadline before moaning about who got what. Have any of these coins sold in the secondary market yet? And if so how do you prove the price damage and dont say you would base it on any ebay sales......

  • our contract is with the us mint. pbgs acts as an agent for and on behalf of the us mint. And since pbgs did not harm us directly we would have to bring suit against the us mint. The us mint could bring suit against pbgs.

    even after the expiration of the FS deadline, there are no damages. The US Mint does not guarantee shipping dates. More compelling however is that the US Mint does NOT acknowledge First Strike designations and have publicly stated same.

    And their response will be that Charlie and others who got the coin already gave up on the book and took a partial filled order forgoing the first in first out. Not saying it is fair but I would imagine that would be the response.

    They only advertise that "Orders will be processed on a first-in, first-out basis". This does not necessarily mean that orders will be SHIPPED on a first in first out basis. For instance, say your credit card screws up, well then you get railroaded till your card gets fixed. Look, buffalonut, i'm on your side. i'm mad as hell at these morons, but there is no legal case here.

    I love corvettes btw. I used to own a 63. The car was a complete nightmare; a junker by enthusiast standards. I put a replaced the small block with a 427 an then drove it under a moose. A friend of mine put the motor in a 4x4 chevy truck. I watched him pull a 14x70 mobile home with that beast.

    Isn't it great that people think this is why we need lawyers in this country? De weed need a case in the courts over what date your package shipped? Really. I guess you could call it a jobs program for lawyers, legal techs, and judges.

    You can't sue the government unless the government agrees to let you. It's called sovereign immunity. that is - the sovereign, or government, - cannot be sued it its own courts. On April 16, 1947, a ship loaded with ammonium nitrate fertilzer (same as what Timothy McVeigh used in Oklahoma) sponaneously blew up in the port of Texas City, Texas, setting off a nearby ammunition ship, other ships, and fuel storage tanks on shore. Over 500 people were killed, and the harbor at Texas City itself was reduced to a smoldering ruin. The entire scheme about storing and shipping both the fertilizer and ammunition had been undertaken and supervised by the federal government, everybody consequently sued the government. They lost. The US Supreme Court ruled that even if the plaintiffs could prove that the federal planning had been really, really stupid (which it was) it all fell under the umbrella of “discretionary function” decision making, therefore the feds didn’t have to pay squat. Since the Mint "decided" to use Pitney Bowes, they are exempt from any damages from doing so.

    There are some very narrow exceptions where government employees can sue for damages.

    If there's a suit filed over this, all that will happen is that the Mint will say in the future "Orders can take up to 1 year to ship. Delivery times are not guaranteed." They'll promise nothing.

    I do not believe we would want that.

    New collectors, please educate yourself before spending money on coins; there are people who believe that using numismatic knowledge to rip the naïve is what this hobby is all about.

    I wonder if the Mint knows that PBGS isn't answering the phones anymore. You can't even check the status of an outstanding order on the web site.

    Makes it somewhat difficult for peeps that don't use the web to order product.
