Need Ebay/Paypal advice and help please

Here is what is going on....

I purchased a Ipod Touch for my wife a few weeks ago on Ebay. I paid as soon as I bought it, with my credit card. A few days ago, I got emails from Ebay AND Paypal saying all of the persons auctions had been pulled and to NOT pay for it. Too late, I already had. I went to Paypal and filed a dispute trying to get my money back. As soon as I filed, Paypal escalated it to a full blown claim, no waiting 7 days. I checked Ebay and there is not even a trace of the auctions left. The guy had good feedback but I used my credit card to have a fall back if needed.

After this, with Christmas fast approaching, I bought another Ipod from another seller with great feedback. So now I have about $500 out there for Ipods, one of which I am getting (I hope) and one I am waiting on getting money back on.

Today, I get this email from the seller of the first Ipod whom I filed the dispute against.


"Your Ipod really is already on it's way It should reach you by 12/10. If it has not arrived by then, We will issue you a prompt refund! Please read below

This actually went from a dream come true to a nightmare. We did so well with this auction, that we were slighty behind on the shipment, seeing this Paypal for what ever reason they wanted shut down our account so we could not pay our suppliers and our fulfillment center, thus a catastrophe ensued and we are out of gas. And what is especially sad is, we have the product but paypal is playing this game with us at the expense of our wallet and our reputation. We are truly sorry for any inconvenience and in Lieu of this we have no choice but to issue you a full no questions asked immediate refund to your paypal account. Believe me we are not scam artists or anything of the sort, our intention was to benefit our customers as well as the ebay community, however this a serious learning experience for us and because of paypal's ridiculous policies, we doubt that we will be conducting business with Paypal or Ebay ever again. Thank You again!

I do not need 2 Ipods, but I do need my money back on one. How should I handle this situation? My wife suggested we just resell one, but I don't need/want the time or hassle of listing and selling one. That is assuming of course that the first one does show up as his email said it would. He has until the 8th to reply to my Paypal claim. I think if he does not, I will automatically win the claim, or thats how I remember it to be.

Anyone with some good advice on how I should handle this?

    As soon as the PP claim can be closed in your favor, allow it to close.
    (If he cannot show SC by the closing date, your money will be refunded
    when the claim is closed.)

    If you get the first item after you have been refunded, send it back with
    signature-confirmation and insurance.

    OTOH, you might want to wait on such a return until the second guy
    actually delivers your item.

    BestBuy, CircuitCity, WMT, Sears ALL sell a nice variety of electronic gizmos.
    And, when you pay for them, you get to take them away with you instantly.
    COSTco is good, too.

    I have sold in the electronics category on EBAY for years. It is a hotbed of
    fraud and deception. MUCH of the "new" merch is counterfeit from China. I
    would NEVER buy anything but collectibles from EBAY.

    Thank you for the advice Storm. I will do as you said and just return it with signature confirmation and insurance. I usually do not buy electronics on Ebay, but with the Microsoft discount it was a great deal. Lesson learned. image

  • If you do get your refund from the first seller, and get the item from the first seller, you should return it to them on your dime.
