Is this worth a negative??

Hello everyone,

Bought a $500 card where the seller advertised free shipping and insurance not offered. I contacted him after I bought the card via buy it now and asked him not to send without insurance. He responded by saying that he would insure if a separate payment was made to cover the cost. I sent right away. Received the card with no insurance or delivery confirmation for that matter. Asked for a refund of my $6.50 insurance and he will not answer after 10 days.

Time for a negative?? Have never had to give one yet.

    why not screw with him and tell him you didn't receive it altogether since he/she was foolish enough to send it without any type of tracking.

    On October 20, he will offer a refund if you will change the NEG to POS.

    Obviously, if he refunds before you NEG, the NEG should not be left.

    tell him you will neg if you don't get your refund. This will get his attention. If he does not respond then give the neg

    Starting about October 20, buyers will be able to "change" their NEG to POS,
    if they want to.

    They cannot change a POS to a NEG............. Not yet, anyway.

    "If you want that NEG removed, send me $20 and I will do it."

    Sellers should expect some of those kind of emails, soon.

    The smartest scamsters will collect the money and NOT remove the NEGs.
    There will, of course, be no way to warn others about the SCAMSTERS.

  • If you made 2 seperate payments then file an INR for the insurance and neg him since you did not get what you paid for.

    I would not do it that way there is a chance Ebay might view that as Extortion and prevent the buyer from leaving any feedback.

    Say you didnt get the package, but would settle for a refund of the insurance price

    Seems every time there's a thread like this, there are a few that post, "tell them that you didn't reveive it." Hopefully I'm not the only one noting this. Wish I knew your eBay ID's because folks that suggest such things are folks that I don't want bidding on my auctions or expecting to do business with me.

    Sorry to disagree but it's perfectly legit to self-insure and the seller takes the risk, and has to payoff if the card is lost.

    But yes he is quite foolish for sending a $500 card without DC - In fact for PayPal a SC is required for a transaction value of $250 and greater..

    However - no neg should be given if you are satisfied with the card.

    I agree with Scott here. The seller should certainly refund the cost of the insurance, but claiming you did not receive the item would make you the dirtbag here.

    This is seller is dishonest and an opportunist. I would want to be warned of a seller like this.

    The guy does not keep his word. I wonder if he made you pay a separate payment for insurance so he can deny you paid for it on the item itself. I am not sure what game he is playing, but the fact he did not use sig confirmation was extremely foolish on his part.

    I guess one can file with paypal that you did not receive, but that is unethical. I hate to get the run around for money that belongs to me and this is a similar situation happening to you.

    Give him the neg and let him crawl back to you to make things right. He needs to refund you the cost of insurance, and an hour or two of your time because of aggrevation (believe me, our friend has pain and suffered enough because of this). You can quantify your time easily. find out how much you make hourly and go with that figure. I know some will call it extortion, but its not. It is pain and suffering just like when you get into a car accident, have a dog bite you and have an ebay seller rip you off. All that is pain and suffering of some sort. I am sure our collector friend could have been doing something else with his time if he did not have to worry about this problem.

    I hope it works out for you my friend. He really is not a good seller because of his integrity.... so neg him.

    There is an item I wanted to buy, but insurance was not offered. I email the person, but got no response. He has 100% feedback and it is a graded gold coin priced above $250. Should I go for it? I mean, if I do not get the item after paying via paypal, do I have recourse? I doubt a slabbed coin can really get damaged in the mail, but if it did, do I have recourse? I do not want to buy only to find out paypal will not help.

    You need to re-read Ebays rules Storm I am sure will clarify this, but it is not only against Ebay rules to accept payment for insurance then self insure, but is against the law in many states to do so.

    I would file an INR on the payment made for insuance since you DID NOT GET WHAT YOU PAID FOR THERE

    No you can't self-insure. It's against ebay policy.

    You cannot charge a specific amount for insurance and not pay for it, either on-line or at the PO, but you can incorporate the cost of insurance in the shipping and handling charge.

    Leias and Grote are correct.

    Things you CAN do inside of EBAY rules and sundry state-laws:

    Self-Insure, provided you do NOT collect an ala carte fee for the insurance.
    This requires the statement of a gross-fee that is all inclusive.

    eg:

    "S+H is $5.00 and includes insurance and signature confirmation."

    ...

    Things you CANNOT do inside of EBAY rules and sundry state-laws:

    Self-Insure and collect an ala carte fee for "insurance."

    eg:

    "S+H is $3.00 plus $1.75 insurance."

    You may also use a third-party private insurer - like CIA - but you CANNOT attempt
    to recoup your annual premiums with an ala carte fee charged to your buyers.

    The 4SC model is an example of correctly and legally using private insurance.

    All inclusive S+H is fine.

    In every state, both insurance companies and insurance agents are regulated
    and licensed. Such regulations have the force and effect of law. Charging an
    ala carte fee for "self-insurance" is a violation of ALL state's law, unless you
    are a licensed insurance company.

    their insurance operations are strictly regulated, there was NO problem with
    those elements of the company. The unregulated parts of the company caused
    the problems.)

    It's important to note, again, that sellers who accept PayPal or credit-cards
    are "self-insuring" their items sold. Lost or damaged items will result in INR
    or SNAD claims against the seller.

    The ONLY case that a buyer is advantaged to pay for insurance is
    in the event that an uninsured lost-item shows confirmation of delivery.
    PayPal will decide the INR claim for the seller. If USPS insured, a claim can
    be filed, notwithstanding the mistaken "delivery confirmation."

    seller will pay directly to the carrier at the time of shipment.

    Update to the story...was going to give the guy a negative, but figured I would hold out a few days more. In yesterdays mail was a check for a $6.50 refund. So all is well...

    Not sure why he never responded to my two messages and for ten days to go by with no communication.
