PayPal "protection" a joke!

A while back, I won a lot of short prints from 2008 goudey from a buyer on eBay. When he shipped the cards, they were in a graded card sleeve similar to what Ultra Pro makes today. I immediately noticed that it was one of the older style sleeves that were perfectly sized to fit PSA graded cards. I have been looking for these sleeves for quite a while now as I get annoyed by the newer, larger sleeves that accomodate PSA/BGS and just about any "standard" slabs. Here's the difference:

I contacted the seller and asked if he had any more of these in stock. He indicated that he had quite a few of them. Before I continued, I asked him to please be sure they were the exact same sleeves that he shipped my lot of cards to me in. I gave him exact measurements for the sleeves via email and everything. He said he had a lot more, so I asked if I could order 1000 of them. We agreed on a price of $50 for the lot of 1000 sleeves. (It's high, yes, but I've been looking for these for a while, so I thought I'd pay a premium as a finder's fee) I paid via PayPal and received the sleeves from the seller. Unfortunately, to my dismay, it was the larger annoying sleeves. I already have a large supply of these and would never pay $5/pack for them. I generally pay $1.50 - $2.00 per pack locally. I contacted the seller and got no response. I filed a Paypal claim and still no response from the seller.
I went into Paypal this evening to escalate it to a claim and within seconds, I received the following email from Paypal:

You have chosen to escalate your dispute to a PayPal claim. By ending
communication with the seller, you are asking PayPal to investigate the
case and decide the outcome. As part of our investigation, PayPal reviewed
any communication you may have had in the Resolution Center.
Our investigation into your claim is complete. As stated in our User
Agreement, the claims process only applies to the shipment of goods. It
does not apply to complaints about the attributes or quality of goods
received. Therefore, we are unable to reverse this transaction or issue a
refund. >>
Obviously, since I received this email mere seconds after escalating this to a claim, there was no "investigation" as stated in their form email. Am I out the $50 here or do I have any possible recourse? If I had been thinking when I paid, I would've paid from my credit card, but stupidly, I paid with a direct debit from my checking account. Ugh!
The $50 isn't the issue...it's the fact that I got duped and deep down I knew better all along, but I took the chance anyway. The seller is still doing business on eBay and hasn't replied to one inquiry. His lack of response tells me he intentionally duped me here. Must be really hard up for that extra $30.

If I had used my CC, I would go that route. Unfortunately I paid with direct transfer from my checking account.
Even if it works, there is a fee.

You could try calling PP and telling them the purchase was an "add-on"
to the EBAY buy. "The seller told me the buyer-protection was the
same and he could avoid EBAY fees, if I just paid him direct."
I dunno.
........

I will try this AGAIN. And, more if necessary.
Despite what some folks continue to insist, there IS NO "Buyer Protection Policy"
for items NOT purchased on EBAY. (PPUA@13.3)
For non-EBAY buys, there IS ONLY a "Buyer Complaint Policy." (PPUA@13.5)
13.5 PayPal Buyer Complaint Policy
What is the PayPal Buyer Complaint Policy?
It is PayPal’s process to help you resolve a problem with a seller through the PayPal Resolution Center for purchases that are not eligible for PayPal Buyer Protection.
The PayPal Buyer Complaint Policy is similar to PayPal Buyer Protection in that it enables buyers to file Disputes for Items Not Received (INR), or for items that are Significantly Not as Described (SNAD). However, recovery of any amounts is not guaranteed and is limited to the amounts that PayPal can recover from the seller’s Account, even if PayPal makes a final decision in your favor.
What is the process for the Buyer Complaint Policy?
Similar to PayPal Buyer Protection, you must file a Dispute in the PayPal Resolution Center within 45 days of the date you sent the payment. Once you have done so, you should attempt to resolve the Dispute directly with the seller.
What happens if I am unable to resolve the Dispute directly with the seller?
You may escalate the Dispute to a Claim within 20 days of the date you filed the Dispute. PayPal will make a final decision for some - but not all - Claims.
PayPal will generally make a final decision for an Item Not Received (INR) Claim,
but will NOT make a final decision for a Significantly Not as Described (SNAD) Claim, or Claims involving the following purchases: intangible items, licenses, airline flight tickets, services, vehicles, live auctions, real estate, classified ads on eBay, or other items as determined by PayPal (collectively “Ineligible Items”). This means that unless the seller voluntarily refunds your money, you will not recover any amounts for a SNAD Claim or a Claim for an Ineligible Item filed under the Buyer Complaint Policy.
What if PayPal makes a final decision in my favor?
If PayPal makes a final decision in your favor, we will collect any available funds in the seller’s PayPal balance at that time. However, recovery is not guaranteed and is limited only to the amounts that PayPal can recover from the seller’s Account. Any amounts collected from the seller will be placed in your Account.

The two concepts are called "similar" by PP.
They are NOT "similar," and they are NOT related each to the other.
Preferably, VISA or MC.
AMEX and Discover can both be a little tricky to navigate on SNADs.
I guess I am guilty of presuming that it was. (an ebay sale)

I should have been more clear. The original purchase (cards) happened on ebay, but the subsequent purchase (supplies) was done off ebay per the seller's demand.
No help from Paypal today and of course the seller still hasn't responded. Oh well...it's not going to kill me...it'll just make me a little smarter, I guess.
