Item not as described? UPDATE

Sold a 1994 UD baseball set on eBay. Auction closed 9/10, shipped 9/11, received 9/16. I receive email from buyer stating that there were 6 cards missing. I replied apologizing and asking him to email me the card numbers and I will try to replace them. His next email says that one of the cards missing was the Arod rookie. Now I have to call BS. I made certain that the Arod was in there before I shipped. The Arod, Jeter and Michael Jordan foil rookie were in separate toploaders inside the 550 count set box. I receive another email this morning saying that not only did I short him 6 cards including Arod, but I also only sent him the Series 1 set (1-280). Once again I have to call BS. I know it was a complete set with both series because it was in a 550 count box in numerical order and the box was full. Not to mention that the Jeter that he made no mention of is card #550.

    He needs to be dealt with as such.

    PayPal has become more than an accessory after the fact
    in the ongoing serial-frauds that are being perpetrated
    against sellers. It is now time to take the fight directly to
    PayPal on this issue, using the sundry courts to do so.

  • Curious, what was this ebayer's FB rating? I'm noticing a lot more of this since Ebay instituted their new TOS. On my more valuable auctions from now on, I'm thinking of blocking all bidders with little or no feedback. I realize I'm losing a segment of the Ebay market, but it seems like it might be worth the risk.

    You will not be able to block any buyers with little or no feedback unless they have problems that would hit other blocks. Just saying no buyers with less than 5FB means nothing. Many of the recent new scammers are Ebay veterans not newbies. I had one last week with 400Fb he has hit 7 others sellers this month with payments that are reversed 3 days later.

    Sellers that cannot handle a little competition are becoming problems too.

    Ask him to return the item for a refund... he will probably pass, but if he does return it... after you receive it, let him know you will issue a refund once he returns the cards he removed. If he does not return the missing cards, Paypal cannot make you issue a refund for a partial return... also, I don't think he will neg you and eliminate a chance for a refund (you will have his money and most of the cards)... if he does, keep the money & cards.

  • Yes Paypal can make him issue a refund. Its the word of the seller against the buyer on SNAD complaints like this. Basically all the buyer has to do is file a SNAD send the item back and if the item shows delivered they win the dispute. The missing cards become lost in the shuffle.
  • Wow. I'm not much of a seller, but it's good info Leiascards. Thanks. Hopefully I can still delete bids. I can't stand a "0" bidder that pops up with 3 days to go. Potential bidders assume it's the seller trying to run up the price. I know that's the case with some auctions, but for the majority of us casual ebayers it's an unfortunate situation that costs us in the end. Anyway, back on topic. I wouldn't send him anything. Have the DC number ready to submit to Ebay and let it ride. Personally, as long as an Ebayer is still at 99%, I won't hesitate putting up a bid. I know you sellers have an *sshole every once in a while, and I understand the frustration.

    not sure if this is any help.....but buyer did say he recieved only 1/2 the cards...right?
    well when item is shipped by the usps doesn't weight factor into the final shipping price? if so is this on the receipt?
    if not could they at least give you an estimate on what the package did weigh..remember 1/2 a set is a big difference.
    all you need is the post office to say you HAD TO HAVE shipped a full set vs 1/2 set.
    You have emails to prove his blackmail....and you proably need to catch him n only one lie.

  • Never thought about the weight. I assume you are correct though. 550 cards would obviously way about twice as much as 280 cards.

    Today I get an email saying he will accept a refund of half the purcahse price ($10). If I send the partial refund can he still file the SNAD claim and get a full refund from Paypal?

    Of course he can.

    IF he has an open dispute/claim, and closes it, he cannot, generally, reopen it.

    IF there is NOT an open dispute/claim, and he is refunded inside of the ORIGINAL
    transaction-details page, he can later file for ONLY the funds NOT previously refunded.
    (The $10 refund would be deducted from any subsequent refund.)

    NEVER do a partial refund via "send money." This allows for a double dip by the scamster.

    Plus pay pal will refund the fees on the $10 if you use the original transaction refund link.

    I would send him the $10...and then block him and move on. I don't imagine you need the welcoming, but welcome to the new eBay.
