Ebay situation and need advice on how to handle this seller....

I won a card on Ebay and for some reason I hadn't paid for it yet. I pay for all my winnings the same day or next at the latest. I had a bunch of family into town and then went on a Cruise. If a payment has not been made the seller usually should file a non payment claim correct? Or a payment reminder or a follow up e-mail I assume? I have been using Ebay since 1999 and never had a problem before. I pay all my bills and all my Ebay purchases. I own my own business as well and I am extremely thorough with my financial obligations. It was 8 days after the auction had ended and the payment had not been made. No payment reminder or unpaid claim made. Instead he calls my phone number that he got off of ebay and left a rude message. He called again and my girlfriend had answered and he was extremely rude to her she told me. I was at my office and she called me really worried about this phone call she got. She is not into Ebay at all but she told me this guy was telling her if I don't pay he is going to sell the card to someone else. Leave me a negative feedback and file a non payment. So I get home listen to the first message on my machine and he was a total dick. I call him back and let him know he will be getting paid within 5 minutes it just slipped through... I told him he could of sent me an e-mail or just filed a non payment then I would of been reminded and paid right away. I let him know it was a honest mistake and I am a business owner and I always pay my bills and once again he will be getting paid now. I then told him I did not appreciate him being rude on my voice mail then call back and be rude to my girlfriend... He tried to talk his way out of it but I hung up the phone.. He then has e-mailed me 5 times trying to be nice and asking for positive feedback once the card is received.... I know he cannot neg me like he said... This was not a big deal at all and I had every intention on paying him the $40.00 with everything going on it slipped through...The guy was a total dick to me and my girlfriend, threatening to file a claim and neg me..
what do i do?
what do i do?

In nearly 10-years on EBAY, I have NEVER called a buyer to inquire about a payment.
To me, the ONLY thing still good about EBAY is that I don't have to talk to the customers;
it's mail-order on steroids.
Summer is a bad time for NPBs, because folks go on vacation and forget to pay. They
always pay when they come back; no problem.
OTOH, some folks are selling stuff on EBAY to get money to EAT. It is good to be considerate
of such possibilities and to pay promptly when possible.

<< <i>If it's irking you like that, go ahead and leave a neg--he certainly deserves it, and he can't retaliate. I would not bother answering his e-mails, though, and after you leave the neg, he may wind up harrassing you by phone further, too. >>
If he did decide to call me it would get ugly, I was nice on the phone to a point. I can be the biggest jerk in the world and he will get the worst out of me if he does call. Maybe if he does call I can record it and play it for the board. That would be funny.. My whole thing is ... just email me a reminder or a non payment claim.. then it would of been taken care of.. didn't need to call me twice!
Idono... just thinking out loud. If this post may cause you any grief, it was not intended that way, just being honest with my thoughts.
A. If it had been paid for promptly, he probably would not have had any reason to be peeved off.
B. Honest mistakes do happen, so I can understand your situation in not paying within a reasonable time. By reasonable time, my opinion is that there is not any excuse for a Paypal payment to take more than a max of 5-7 days to take care of(unless we agree to something before the fact). Money order is another story. I have given buyers up to 28 days for a m.o. to arrive, before I contacted them to see if they were planning to pay.
C. He had every right to call one time concerning payment, but did not have the right to be a jerk about it. He could have handled himself better if it did truly happen like you claim.
Neither party was perfect pertaining to this transaction, by your own admission. So, I would leave no feedback, as long as the card arrived safely, and as described in the auction.

Yes, but the OP "forgot" to pay, before he got distracted with whatever.
That happens on EBAY; it shouldn't but it does, and sellers KNOW it does.
If sellers need/want the money FAST, they need to use BINs and require
immediate payment. Otherwise, they assume the risk of slow/no payment.
Leaving harsh messages over payment on a $40 card might indicate that
the seller is wrapped too tight to play on EBAY. It sure says to me that
the seller is not acting professionally; notwithstanding the buyer's inconsiderate
negligence, the seller seems to have gone ballistic over $40. And, he called TWICE.
I like NOTHING better than collecting money. But, I would be grossly embarrassed
to call somebody on the phone over a minor EBAY transaction. The NPB process
is in place and easy to use; I don't need to disgrace myself by showing my true
colors on the telephone, in order to collect payments.
IF the seller is a poor/broke person AND a "new" seller, it is understandable that he
might go into reactionary mode. BUT, there really is never an excuse for being
mean to EBAY buyers who have not proven to be scum. Slow payers are NOT all
scum; there are legit reasons for slow-pay: ONE such reason, as goofey as it seems,
is "I forgot."
Experienced sellers tend to be EBAY-centric in their lives. The hundreds/thousands of
money-making listings we have up are always on our minds. Buyers have other stuff
in their heads; there is nothing we can do to make that not so.
I am generally VERY pro-seller, but when we take over, we are going to have to kill
off some of us, too. The FACT that EBAY has declared war on sellers is not a good
reason for sellers to think of every transaction as COMBAT, and every buyer as a
scamster/deadbeat. Being "reasonable" is a responsible - and profitable - way to
operate and succeed on EBAY.
He can threaten to leave negs or whatever and it means nothing under the new system. All he can is file a UPI after 7 days and if you can prove payment on the item you will not get a strike and if he follows through on it he could get suspended.
