OT : eBay wins a counterfeit lawsuit

Hmm.

eBay vs Tiffany's

“Tiffany has failed to demonstrate that eBay knowingly encouraged others to dilute Tiffany’s trademarks...Rather, to the extent that eBay may have possessed general knowledge of infringement and dilution by sellers on its Web site, eBay did not possess knowledge or a reason to know of specific instances of trademark infringement or dilution as required under the law.”

Good - If ebay is forced to assume more responsibility for what's listed on their site, then the rest of us will be flipping the bill with our seller fees.

Hopefully, EBAY will now stop limiting the number of items folks can list
in designer fashion. That would be a good thing for honest sellers.

Sadly, the decision is likely going to cause the VeRO folks to pull every listing
they see. Under the VeRO scheme, EBAY has given members the absolute
right to pull ANY listing they want to pull. No proof, no inquiry, just cancel the
    listing.
