Anybody know eBay seller Steven Phipps, AKA Mich.ave

I kinda feel like a tool asking for a refund but I'm pissed, dammit!

The guy sells this Marion Gaborik auto puck w case that I buy for a charity auction. I'm somewhat mifted he wants $5 to ship 1st class mail but I never really thought too much about it until the package shows up. Here's the deal, he ships the puck and case in a 6X9 bubble envelope with not so much as even tape to hold the case together. Of course, it's destroyed in shipping..dah! So I go buy a new one for $4 and email him politely that the puck arrived in great condition and the case was destroyed. I ask for a $4 refund and get no email response in five days so I open a Paypal dispute. He emails me that he's sent $4 cash by mail, lol, and would I please end dispute asap.

I know it's only $4. I check on the Paypal dispute and here's the message he leaves

<< <i>"Was packaged like all the rest(6x9 inch bubble envelope) check my feedback, shipping insurance was offered but declined sold as-is no return(stated in auction)Should not faulted for post office damage. >>

Well, we all know that the USPS won't cover damage from poor packaging and I'm not holding my breath on a cash refund....I just feel like throwing the guy under the bus cause he poorly packaged and now wants me to eat the $4 for his mistake.

Am I as big a tool as I feel asking for $4? At the same time there was about a .0000001% chance that the plastic case was going to make it in one piece, right?

He could have sent that in a priority mail box for 4.60

I say stick to your guns, tell him you will end dispute when his 'cash' arrives.

Another seller who just does not understand PayPal.

Insurance protects the seller in PP transactions; not the buyer.

IMO, yes, it is tooley to ask for the $4, BUT it is ALOT more tooley
of the seller to refuse to simply give you the $4.

A few years ago, a terrestrial internet outfit came out and installed their antenna assembly on my roof. I was required to pay for the antenna--IT WAS MINE. Well, the service sucked, and I canceled. No big whoop--until they came out and wanted to go on my roof to take the antenna back. I told them that I paid for it and it was mine. The dork told me that a refund check was "already in the mail" for it, and that he had instructions to take the antenna. I told him that I'd call them when the check arrived, and then we could go from that point.

Like I said, that was a few years ago and I never received the check that they said was already in the mail. The antenna is still on the roof, too. image

Its kind of like shipping a lightbulb in a box unprotected.
If its broke, "its not my fault it broke during shipping..."
