1938 & 1939 Jefferson Nickel reverse help please

I'm going through my album of Jefferson's' and trying to learn more about the different reverses.
Can someone look at mine and tell me what I have and grade opinions please.
Any other info would be appreciated as well.

    Rev of 38 on the first coin, rev of 40 on the second

    I know little about these but the 38 looks possibly like an MS63. Really weak in the hair and from the photo the steps do not look fully developed.

    The 39 has those blacks spots which IMO are death to a coin.
    I decided to change calling the bathroom the John and renamed it the Jim. I feel so much better saying I went to the Jim this morning.

    The very first step on the Monticello building of which the 4 pillars rest on is very thick for the reverse of 1940 nickels. Whereas, this first step is very thin for the reverse of 1938 nickels.
