First experience with NPB....will I get fees back? Updated!!

Yesterday I listed a 2007 Topps Chrome Red Refractor Football Set on ebay and a seller that has the same set for sale bought my item within 15 minutes of it being listed. He then sends me an email saying; "You want to mess with me, You don't know who you're F--king with?" Wow....I was shocked to say the least. I'm sure this guy isn't going to pay for the item and I'll have to file a NPB after seven days. Will I get my fees back? If I decited to pursue this guy with legal action (it's $3200 bucks) could I win?

    And I dont think legal action is necessary since you're not "out" the set. You still have it.

    You may be able to go to ebay with his response and be able to terminate the transaction early. ebay should pay attention with such a high valued item. If not, play it out and relist. Also, block the bidder.

    Send a copy of his E-Mail to EBAY Safe Harbour and drop the whole thing in their lap. This moron should have his account suspended at the very least.

    I would definitely bring it to Ebay's attention. Then as already mentioned relist and block the bidder.

    That idiot has some nasty feedback!

    Somebody here, I think Storm, has a contact with ebay. See if you can find that person, and turn the loser in for auction interference.

    If you are a PSer, call your rep NOW.

    Otherwise, call T&S. Ask for a supervisor.
    Be prepared to FAX a hard-copy of the
    message from the psycho.

    Tell T&S that you feel threatened and
    are "afraid to list anything else on EBAY."

    Auction interference is a TOS violation. If
    the scumster is a favorite PSer, nothing
    will happen to him; otherwise, he should
    be NARUd.

    All of your FVF fees will be refunded. You
    can ask for the listing fees, but they are
    likely lost.

    The guy has engaged in unfair business practices.
    If he lived in your jurisdiction, you could sue him
    in Small Claims.

    If you have a friend with disposable IDs, perhaps
    the sumbag's listings will have some fast problems.

    also Stevie, I am not sure but I believe your "Pick 5" style auctions might be a violation. I know they used to be, but maybe they are ok now? Anyone know?

    They are a violation. EBAY would have pulled the listing, if it was reported.

    THAT could throw a wrench in the T&S negotiations.

    "Unclean Hands," and all that jazz might be brought up. A poofed listing,
    for a TOS, is usually not entitled to listing fee refunds. BUT, that should
    not nullify the request for FVFs.

    If the guy has a friend there, he can raise YOUR TOS violation as part
    of his defense. He could get out of paying after the fact by saying he
    "just realized" that the listing was a TOS and does not want to pay for it.

    YOUR FVFs would still be refunded.

    Anyway, call T&S, and if they gripe about the pick-em listing just say,
    "Ohmy. I am terribly sorry. I did not know that was against the rules."

  • I appreciate everyones input.....I did call ebay about his use of profanity and they had me send an email documenting the ordeal. Ebay sent me a standard email back saying that they don't like it when their customers use profanity but they can't do anything about it. I'm not really offended by the profanity, I just wanted to report this guy. From everyones suggestions it looks like I need to go about it in a different way. I don't have a problem with losing my listing fees....but I'm glad to know that I won't lose my FVF.

    Playing the email game with EBAY is a waste of time.

    The issue is NOT, obviously, profanity. It is auction interference.

    The security #s are on the site. T&S is usually no more
    than a few minutes wait.

    Live-Help (dead help) is a waste of time. CALL T&S.

    In the EBAY survey I took last week, one of the questions
    was:

    "When you contact Live Help, does it seem like you are
    communicating with a real person?"

    YIKES!!!!!!!!!!!!!!

  • Allen, thanks for the heads up.....I'll pull my "pick" style auctions. I'm still fairly new with selling on ebay (about a year now) and I didn't know that was a violation of ebay terms! I don't understand why ebay wouldn't allow this kind of auction. I've completed about 20 to 25 of them now and they get their FVF fees.

    If a competitor does not complain, they usually don't get pulled.

    They are TOS violations because they deprive EBAY of additional
    listing fees.

    Picks that are OK include IDENTICAL garments that are s/m/l.
    A hard-butt T&S shopper will cancel listings that offer "s/m/l
    in Pink or Blue." EBAY wants things listed ala carte so they
    can collect listing-fees on EVERY item.

    That is so crazy. His description says that it'd be next to impossible to put the set together again. I guess you f****d with him all right. That is too funny. I hope you get your fees back and that joker is sent to eBay purgatory.
  • I honestly don't think ebay will want to NARU this guy. Even though he doesn't have the best feedback he does quite a bit of business and with fairly large dollar items. Ebay wants all the business they can get....thats why they are so vanilla on complaints.

  • I spoke to Trust and Security and they said to just relist the item (which I did) and to just end the item if this guy actually pays. I would love it if he was stupid enough to pay $3200 for this item. We'll see what happens?

  • As far as your pick 5 auction goes my understanding is it does fall into to the category of allowable choice auctions.

    In order to do a choice auction you have to be able to fulfill all possible orders:

    Say I am selling womens dresses I list 25 available in the listing, but only have 10 large, 10 medium and 5 smalls. If 20 people wanted larges I could not fulfill the listing that would be a violation. Now if I had 25 of each size then yes I could list it that way since I can fill all possible orders.

    Since this is not a dutch auction and you are listing the cards available including multiple quantities if available you are able to fulfill the listing. I may be wrong, but that is how it was explained to me by a Power Seller rep a couple of years ago.

    Man they are bright too. If you relist now you will not get a relist credit after you complete the UPI on the item. If you wait you will get a relist credit should the item sell on the relist after the UPI is finished.

    Yeah, it's the reason I listed my item.....I wanted to have something for potential buyers to see as an option. I have the two main cards graded 10's by PSA.

    That was one of my concerns but the rep assured me that I'll get a relisting credit if the UPI is completed.

    DO NOT FOLLOW THE ADVISE OF THAT REP!! You will not get your relisting credit. You will get your FVFs but not the relist credit they are 2 seperate things. Anytime an item ends without a bidder or a completed UPI you can relist the item using the relist button. You will have to pay basic listing fees for the relist but once the item gets a bid the listing fee is refunded to your account.

  • I was right....he didn't pay! At least I got my FVF back (over $60 in this case). I left him negative feedback and of course he retaliated. I'm not too worried about the neg on my feedback.....I think buyers will see the true story on this one.

    If ebay follows through with their change in feedback (coming in May I think), this will open the doors to crazy NPB'ers like this guy!
  • They have said that they are going to do something in regards to NPBs on the feedback issue. Just no clue what it is yet. As it is now a buyer can leave feedback for any item they purchase, but if they do not repsond to the UPI the feedback is removed but the comment remains. Maybe they will fix it to where this applies to all completed UPIs not just the ones that are not responded to,

    on the feedback it would have maybe been better if you would have listed his item number and said he was interfering with your auction, that way people can tell he had no intention to pay

  • Listing the auction number might have been removeable under Ebay rules if that happened they would just remove the one FB not both.
