Need help on a PayPal claim

I sold THIS card back on 1/31.

The card was graded as a 1979 Kellogg's Kelloggs #14 Buddy Bell and it says "No Trade Line in Bio" on the slab.

Well, this is the way I sold it.

Turns out it's the card that DOES have the "trade line in the bio" (I honestly know nothing about this particular issue, so I dont know either way).

The buyer filed a paypal claim stating that it was not as advertised.

I'm disputing it because I sold it the way it was advertised. An example I gave the buyer was this: If I buy a car with 300 horsepower, then sell it to him, and it turns out it only has 250 horsepower, how the heck was I supposed to know? It's not like I have a dyno at home.

I'd like your thoughts on this. He wants $7.00 back ($1.00 for the card, the $3.00 he paid in shipping, and $3.00 more to ship it back to me). It's not a lot of money, but I feel like I'm getting the tail-end of this deal.

    This guy is an idiot if he's trying to send back a $1.00 card. I wouldn't give him anything.

    A $4 auction? Are you kidding me? Tell him to send the card back and you will refund his purchase price including shipping, but that he is responsible for shipping it back to you. It should only cost about a buck for him to ship it back anyway.

    I offered to refund $4.00 ($the $1 card and the $3 shipping) and he rejected it. He wants $3 more to ship it back to me.

    If Paypal sides with him, he will only get $1 plus $3 and will have to give Paypal proof that he sent it back.

    Let him do his PP process. They will ONLY give him $4,
    and he will have to pay to ship it back to you.

    ......

    YOU are responsible to your buyer for the mistake on the flip.
    PSA is responsible to you to fix the flip.

    They will ask you to respond.

    ONLY say, "I will be happy to make a refund immediately upon my receipt of the returned card."


    In a few days, PP will notify you that the buyer was instructed to mail the card to you. When
    you tell PP that you have the card, they will issue the refund for you.

    I would not chat with the buyer anymore.

  • You're offering to take the card back, which is the right thing to do, even though it was mislabeled from PSA.

    A lot depends on the attitude of the guy. If he was a jerk, I'd make him 'jump through the hoops' with filing complaints, returning the card, etc.

    (If he filed with them before contacting me, then he would make my jerk list, though.)

    If not a jerk, refund him and tell him to keep the card.

    He hasnt been a jerk, but I'm not willing to budge on the shipping. I'll give him his $4

    Does he feel you were dishonest in your listing? It is obviously a PSA mistake. Shipping fees seem to be of more value than the card. Offer to refund $4 and let him keep the card. Then block him from your auctions.

    Since the item is mislabeled, you are going to have to go through more trouble than it is worth re-selling the card or sending it back to PSA.

    For a $1.00 item, I would just refund the guy his $4.00 and let him keep the card. The bone of contention is the shipping, so if you let him hold onto it you are only out $1.00 at the end of the day.

    That might actually be a good idea because reselling it will be a pin in the butt.

    I thought we were done with this issue. The card I need is the one that he posted and my bid was larger than $1.00 but no other bids were made and the starting price was a $1.

    Again here is an overview of the whole event.

    I wish I would never have bought that card. Long story short: the card was advertised as "1979 Kellogg's Kelloggs #14 Buddy Bell PSA 8 NM-MT" (item number 150208332478). Here is the link to the listing if you want to look. As you can see he wrote, "This is the variation with no trade line in the bio. "

    There are two versions of this card 14A and 14B (one with the trade line one without). PSA mislabled the card and I informed him of this and asked for a refund.

    His reply was: "Hey Mike, take a look at the PSA label, I listed it as PSA graded it. You got what you paid for."

    My reply: "I bought the card not the label. The card is incorrect. I'm giving you the chance to correct this between us. Please let me know if you would like to correct this."

    No reply from him.

    My follow-up email: "I take it from your non-response to my last email you have decided to ignore my request for a refund. I will now start a dispute case with ebay concerning this item. I'm sorry you felt the need not to do the right thing and refund this purchase. As I stated in my last email, I bought the card not the label that is incorrect."

    PayPal found in my favor after the dispute was researched by them. I left him a negative feedback for ingoring my requests for a refund ($1 plus shipping!) and having to go through dispute resolution. He then leaves me a negative in retaliation ( and I see people cheer him on for this on the blog ). I pay on time and try to resolve the issue between us and I'm the bad guy. I have bought and sold on ebay and had a 100% positive feedback until this. As a seller I have supplied a refund to any buyers request to keep up a good customer service history.

    I guess I can't win.

    As of this posting he has refunded $4.00 and I asked if he wants that card back and where to send it.

    He also apologized for the negative feedback, "I just paypaled you $4. Regarding the feedback... sorry pal... you won a dispute, there was no need for a negative. "

    But I'm still stuck with it.

    As to telling me were to shove the card (Leiascards post), why would you want to piss off customers? I had a perfect feedback record and paid for all my purchases quickly, only returning one other card. As a seller I had no problem refunding and taking back items if the customer was not happy.

    To answer the question, I would have offered the refund and said, "Keep the card." This would have been worth the very positive feedback the this level of customer service deserves.

    I hope this puts this to rest.

    my new rule is anything under $10 is not worth the hassle. You could have just flipped the card you received in error back on ebay for $.99 and got rid of it. Why bother with all the hassle.

    For the seller, just refund the $10 and move on. Who cares.
    Running an Ebay store sure takes a lot more time than a person would think!

    I collect some specific card sets and have collected Buddy Bell items for several years. I really don't think that would put me in the mental category.

    Nightcrawler welcomes me to the site a few threads ago and then makes this comment, why would any person want to post here?

    I hope this isn't a reflection of the entire site.

    Welcome to the site. Nightcrawler made that comment on March 3, before you started posting here. Please don't take it personally. I doubt he even remembers writing that and I also doubt that he meant anything by it other than trying to crack a joke. As a whole we are a good bunch of guys that just want to talk about cards.

    Truth be told...I remembered this thread and knew he had gone through with the dispute. His story on the locked thread stunk from the first moment and I didn't want to let it go.......especially when people started to tell him he did the right thing.

    As I stated on that thread...I hope he learned something through this.

    Case in point: The main focus of my collection is Jim Gantner cards. image

    My other two focuses are Robin Yount (who shares a 1983 Fleer card with Buddy Bell, as I'm sure you're more than aware) and Paul Molitor.

    Honestly, if I were either of these guys I would've let it go. I got the wrong card for $1? Oh well. The buyer wants a refund for a $1 transaction? Sure, why not. How people get wound up and create situations over insignificant things like this amazes me. Alan's come here and created multiple threads which has lead to another Alan-bashing session and no doubt hours of anxiety and frustration for him. Mike has felt the need to come to a forum full of strangers to give his side of the story and defend his actions, which has no doubt added unnecessary frustration in his life. And all this over a $1 transaction. You all really need to let stuff like this go when it happens.

    The indignance in Alan's response to the buyer's email probably threw a gallon of fuel on the fire. Any reasonable seller would tell the buyer to keep the card and refund the $4. Actually, after Paypal takes their cut, it would've only been $3.58 out of Alan's pocket. Yikes.
