What, if any, is my recourse here?
Sorry for the double post...internet connection issues...
Anyway, I win this on the bay the other day. Seller didn't offer insurance. It arrives in the mail today like this:

No, that's not my hand, it's my girlfriend's, it arrived at her apartment today bent in half, on cardboard, in an envelope without "Do Not Bend" written on the envelope.
Do I have any course of action or am I SOL?

2. Could never hurt to ask the seller. send him the same picture. I am sure he would say that as the auction states, insurance is optional.....but that really means nothing at all as it is the sellers responsibility to make sure the item arrives as it is described. If he says to buzz off.....take it up with paypal.
I know some on here will say it is not worth the (inevitable) negative, but nothing will ever change if buyers do not say something when needed.

edited to add: I'm only bummed because I've wanted this card for a decade. When I paid by paypal, insurance wasn't an option, I should have asked.
LOL - just kidding. That's my favorite misconception about ebay.
Anyway, all you have to do is file "Item Not as Described". The seller is responsible for the item until it is in your hands. That happened before it was in your hands, so if you paid by paypal you get the auction amount refunded. You will have to return the item though.
I'd notify him first. If that does not work then I'd go the PP route.
I would not tell him my strategy.

I informed him of the problem and asked if there was a middle ground we could come to. It's not worth a PP claim on less than $15, but it sucks either way.
